HELP 2004 E220 CDI W211 722.6 Gearbox surging jerking shift issues

I have a shift/gear problem which is really bad in the morning when the car is cold.

When I set off the car accelerates normally but seems to hold onto the gear then it will jolt into the next gear and start to surge like I'm on and off the accelerator?
Same into the next gear up, again whilst accelerating normally the car jerks and you can visibly see the rev counter needle bouncing up and down?

The really odd thing is the car does not go into limp mode and there are no fault codes from the ecu?? There is enough of the correct oil in the box.

2004 Facelift so I don't think its a valeo radiator but how can I tell for sure?
 
Facelift wont have the valeo issue.

is this 5 speed or 7?

if 5 the n sounds like a fluid and filter change is in order.
 
If it's 2004 it will be pre-facelift and could have the Valeo issue.....facelift was late 2006.
 
Just had an update from my mechanic, he's re checked his equipment and the gearbox is reporting shift errors so I need to get it on star don't I?

I'm actually pleased because if there's a code, it will tell me actual problem won't it? even down to a solenoid fault?
