2007 e280 gear problems

Intermittently (once a week or so) whilst driving I find the car goes into 2nd gear and stays there. I can still shift the auto lever up and down, and it shows on the screen, but makes no difference. Also when this happens, the C/S will not change.
If I stop the car, and put it on PARK, it solves the problem temporarily.

When was the auto box oil changed/ checked. From what I hear this is the normal cause for this problem. Mb claimed the box was "sealed" then changed their mind and decided the fluid should be changed every 37k miles

Had similar problem with 05 CLK (7g) New electro plate fitted at around 55,000 miles
