2009 E280 Problems

Hi,

I just purchased a 2009 E280 on the 15th Jan. Picked up the car on the 17th Jan and all was fine.

A few days later I was looking through the paper work and discovered that the car belonged to Hertz for almost a year. This was not really a problem as the car seemed to be in a very good condition.

I recently noticed that there is a few problems with the car:

1. Rattle in passenger front door.
2. Exhaust tip very low on passenger side at rear.
3. Loud rattle in dash board.
4. Rattle in drivers door.
5. Exhaust seems to be pushed in on passenger side.
6. Boot not closing properly on left hand side.
7. Very loud squeaking noise coming from brakes.

Problems 1 and 2 was fixed under warranty but the exhaust is still not sitting right and it is still looking like it has been pushed in possibly in an accident but the dealer says that there is no way that this could have happened as the report shows clear.

I have now spoken to the dealer about returning the car as it is still just within the thirty days. However they have said that it can only be swapped with another car that they have at the same location and that they will not issue a refund.

I do not want another car from them but instead I want a full refund as I have seen another single owner E280 at another location.

Can you please advise if I am entitled to a full refund and what steps should be taken next.

As I understand it the car must be of satisfactory quality, fit for purpose and as described.

What this means is going to vary depending on the item purchased, but I would have thought that quite high standards should apply to a one year old car purchased from an MB dealer.

I think you need to give the supplier a reasonable opportunity to fix the issues.

If you feel that it still does not meet the required standard you need to write to the supplier formally rejecting the car. You should stop using it. Perhaps you could leave it at their premises or offer them the opportunity to collect it.

You could talk to trading standards / citizens advice for more help.

Quite a lot of home insurance policies offer legal costs insurance. Worth a check.

I think the MB 30 day offer only give you the option to swap the car if you don’t like it for any reason.
