Despair with Insurance Company

Thank you all for the info and advice. I didn't take my son's account at face value. A few days after the incident, I visited the scene and met the owner of the house just opposite. He called his 14yr daughter who had seen the whole thing and who confirmed my son's version of events. Her parents didn't want me to involve her as she was recovering from a serious illness which I understood fully. I still don't want to involve her but I suppose if hardy comes to hardy.....

Digging deep into the memory banks.......theres a bit tucked away in the Road Traffic Act that states "owing to the presence of a motor vehicle"

Sounds like the other party has incited this and made some spurious implication.

I suspect what has happened is bearing in mind the above , the insurance company has made a commercial (aka money grabbing) decision that due to your son effectively telling them he was involved in an incident he is now evidenced as a higher risk.

Sounds made up , is ludicrous and I would battle it but unfortunately in this day and age that's what happens.

Would I have told them ? No . I base that on an experience a few months back where a boy racer flipped his shopping trolley after spinning it on the road ahead of me. I was a witness and not an involved party and would go to court on that basis.

Not exactly the same circumstances of the OP, but a number of years ago on a country road, I was travelling uphill and a young cyclist who was coming downhill towards me, lost control of his bike and landed on the road near us without hitting our car. After checking for injury, we took him home, just a couple of hundred yards away. I wasn't asked for and didn't leave any contact details, but I called into the nearest Police Station and explained the circumstances to the Officer on Duty.

His response was that, as there was no contact with our car, there was no need to report it as an accident. He did ask me for our details 'just in case' there was a comeback and they could get in touch.
