simple way is don't do anything, answering acknowledge you have seen the letters and they will send you even more letters.

I had a fine from the same company about a year ago due to their broken ticket machine but that's another story, they kept sending me letters and they have eventually stopped. I haven't received anything for about 6 months now.

They would consider taking you to small claims if you owe them a fair bit of money, but even then you can argue you don't know what's going on as there is no proof you have received and seen those the letters unless they're signed for and got your signature on it.
 
Go to the websites already listed as there is a lot of bad advice potentially being thrown around here. First off you should not admit to being the driver of the vehicle, only the registered keeper.

Some companies you can potentially ignore as they have no history of going beyond the debt recovery phase, but others do take it to court.

Read the sites at moneysavingexpert and peppipoo and get some advice from those informed on how best to respond.
 
Keep a paper trail, the ostrich approach may work 50% of the time, good if you are guilty or have a weak defence but in your case 1x letter then call their bluff.

So. I shall:

1) Write and clearly state I did not park and never have parked in this car park or premises.

2) Ask for their photographic proof of my parking/over stay.

Nb. Their letters both contain two dated & timed photos of my car with me driving it. These are taken on the on/off ramps to the services and NOT in the car parks. Also both show the car is on the road and not parked.

Are times plausible for a " drive thro" plus one hour and did this happen close to / the week following October 28th - which would be explained by the entrance camera on winter time and the exit camera still on BST thus adding one hour to your stay!

Do the photos show the vehicle parked, or driving through?

If driving through, are they assuming that between the drive-throughs it must have been parked, but they do not actually have pornographic evidence to this effect?

Both photos clearly show the car being driven ON THE ROAD (entrance & exit) no photographs of any parking. Why? I never parked or stopped.

Having had a look at the site map [ google maps- may not be up to date of course] it would appear that there is more than one exit and entrance to the site? If they were only monitoring the off ramp and exit to the motorway then if you exited the site in the morning via a non monitored exit and re-entered the site in the afternoon via the same non monitored entrance and then exited via the monitored exit to the motorway it would then appear to the parking co that you were on-site all that time???

As has already been suggested, visit PePiPoo and / or MoneysavingExpert for advice before you respond as it's easy to snatch defeat (or at least end up having to defend a court claim) from the jaws of victory with these unscrupulous clowns. One particular piece of advice is to never phone any of them as it's a waste of your time and will potentially give them more ammunition with which to harass you. This is the classic "double dip" where the parking company record the first "in" event and match it with the second "out" event, conveniently missing both the first "out" event and second "in" event. Et voila! We have and "infringement"!

DRP are powerless "debt collectors" who will snow you with demands, final demands, absolutely final demands and positively absolutely final demands with ever increasing quantities of red ink on the page and spurious (but empty) threats. File them away but do not respond.

You will need to to respond to CP Plus to robustly deny any liability, but do some research as to the best way to do that before doing so.

I did raise a post over there and they (as always) very helpful and legally accurate. However I also telephoned the Services and spoke t very helpful Manager there who immediately cancelled the ticket (having asked that I scan and email it to them first) which I did. There attitude was helpful and very polite.

I got what I wanted and am very grateful for that. Thank you to all on here who offered help.

The lady I dealt with mention that the entrance and exit roads that I was photographed using are deemed as "no Entry"and or "private roads for access only"

No I am not disputing this, and neither was I challenged on that. Howver I have asked them to clarify this as in twenty years I have never once been challenged or seen the thousands of other motorists who use these roads being challenged. I have no desire to lead any campaign here. Just curious what the correct legal position is. I shall re-check the signage again today.
 
I suspected this might be the case Bruce ;) when I did my google "street view" drive thro of the road in question. There is definitely a NO ENTRY/ PRIVATE ROAD SIGN after the Travel Lodge/motel and before the HIGHWAYS ROAD DEPOT - ironically the signage in the other direction reads twoway traffic! Assuming this is a private [ UNADOPTED?]road to have any legal standing the sign would have to have a TRO [ traffic regulation order ] lodged with the local authority-- and even then ??

I expect its just a ruse by the parking company to route all traffic exiting their site via the camera covered exit leading to the motorway? :rolleyes:

As always a big thank you to you. They are being a bit silent with the signage situation. That makes me suspect it is not enforceable but used as a background threat if required.

But hey. It was great to speak to a helpful, polite and honest lady here. I was expecting WWIII and had my defences set to match. How nice not to have the row or the argument, but enjoy the discussion with somebody who actually wants to help.
