Faulty Nox sensor means new exhaust needed too, cost of £2000!!!

Been told we need a Nox sensor replacing (getting message 'engine start not possible in xxx miles'). The problem only started following a service with MB. Been back to garage and first time told no problem with sensor (message seemed to just clear itself), then second time told sensor is faulty and has welded itself to the exhaust which means there's an 80% chance the exhaust will be damaged and need replacing at a cost of £1300 plus £700 quoted for sensor.
My point is :
a) from looking on here seems sensor problem is common and lots of people have managed to get theirs changed FOC
b)surely if the sensor can not be removed without damaging the exhaust then this is a design problem therefore why should we be responsible for this?
We've complained to MB Customer Services who seem to think there's nothing they can do (seems unfair to be treating customers differently. If they are replacing some FOC surely they should replace all. We've also complained to our MB dealer who has finally offered to contribute 50 %. This still means we could be liable for £1000. It seems unreasonable to charge us for a new exhaust when there is nothing wrong with our current one at the moment but it may be damaged by them if we give the go ahead for the sensor replacement. We are in a very difficult position as we can not use the car at the moment because of this so we need to do something. It's a 2015 E200 with 62000 on the clock.
Wondering where we stand legally. If a garage damages another part of your car while working on one thing are you financially liable for this?
 
Does your car have a full MB service history? That can help your case.
 
Well if it was me and like you lived in Hampshire I would take the car to Prestige at Waterlooville,Ollie will be able to give you the best chance of getting that sensor out.
 
I find it strange mine had a similar scenario exactly the same error message in the dash, tried to clear the fault wouldn't clear NOX sensor gone they then said that they would replace both FOC (they phoned there and then to get MB approval for FOC authorization) no mention of any issue if the sensor was seized in the exhaust.
Trying to understand why mine would be FOC and they wont on yours
I bought my 65 plate E350 CDI approved used was approx, 6-8 weeks out of used car warranty, and at the time hadn't had the engine software ECU update.
For completeness has your car received this recall yet?
As people are speculating that the new software can make the sensors to fail prematurely and it is expected hence why the FOC replacement when they fail, and i was just lucky with mine as I was told all the warranties and service schedules had been given six months grace because of lock down.
To be honest I would very much doubt that the sensor will be seized as there have been many many posts about the NOX sensors and none of the ones I have read have ever had an issue with exhaust replacement through a seized sensor.

How long is it out of the MB used car warranty?
 
I thought “engine start not possible in xxx miles” was adblue related....

How did the 2nd place know the sensor was “welded / stuck” in plave? Did they try to remove it? Do they have the correct MB diagnostic system (STAR) to decode the error codes?

All very suspect
 
If it was 'seized', why wouldn't anyone with any sense get the threaded boss cut off the pipe and a replacement threaded boss welded in for, say ... well under £200?
Probably because it was a Mercedes garage. They don’t do repairs, just replacements.
 
It may be too late for my input, here goes. Back in July the engine management light came on and checking it out confirmed the NOX sensor. My local repairer suggested I go to MB direct as they guarantee the work and fit the correct part and update any software required, MB quoted #600. My local MB specialist quoted less than #400 with a 4 year warranty inc software update and the details are logged into the MB system.
Re "welded" NOX sensor. A pal of mine who is RR trained said this is a problem, but when heated up by a hard drive or flame heat removeal is possible.
 
Yes, I had the work done and all was ok. One amendment to my previous posting, the warranty was 2 years not 4. A tip, when my local repairer advised me to go to an MB specialist it was because there are a number of options for the NOX sensor and he could not guarantee that the replacement would work, nor could he update any software required.
