Gearbox ML320 2006

I have had this car for 4 weeks and twice I have had a strange gearbox problem, both times at traffic lights. Drive to the junction fine, wait to move off and it feels like the car is in third gear, wont pull at all and wont change gear with extra throttle.
Stop, turn off ignition, restart and all is fine! On both occasions the car was just getting warmed up but I have done around 600 miles and only had this twice. Any ideas guys? ATF fluid level/filter maybe?

Sound like the car is going into limp mode.

Probably not a gearbox problem, It could be the MAF needs cleaning/replacing.
