Got crashed in to :( gutted

Myself and my fiancé were out in the e55, having a good day, drove down a duel caridgeway, came up behind a landrover freelander that was driving at about 30mph, we over take and I notice his green P plate as he swerved in to our lane then back to his. I made the comment that he should maybe learn to drive again!

Anyway half a mile down the road we come up on traffic waiting at some lights, sat minding our own business having a chat and a laugh, car infront starts to move off, I didn't get my foot off of the brake before a huge and horrible bang followed by the most disturbing noise my girlfriend has ever made!

We had just been hit by the freelander who by time he hit us had sped up to around 60mph and didn't attempt to brake! I'm pretty sure he was on his phone but unfortunately I can't prove it :(

I jump out of the car in a pure rage, look at the back of the car and realise that it's pretty much a write off I think, he says "my brakes no work" at which point I wanted to drag him out of his car and kill him ha! My mind went back to my fiancé, police and ambulance were called, clear case that it was the other guys fault, he couldn't speak much English and had to produce a letter with his name and address on.

We are both ok, some bruising and pains, pre tensioners went off so both got bruising to shoulders and really sore stiff back/neck.

Police breathalysed myself and the other driver (I don't drink) so blew 0 and the other guy was just under the limit but as he was just under police said they can't do anything :(

Boot floor has folded in about 18-24", passenger rear arch has dents in it, boot lid and pretty much the whole rear is toast!

Lights smashed but still working! Car drives (exhaust bent) the police allowed me to drive home (2 miles) with an escort (not high speed :( ) srs warning on the dash saying visit workshop.

I'm devastated I love the car :( I don't think it will be fixed I think the damage is too much, if it is written off I will be replacing with another e55 or poss a cls55 I just hope I get a decent payout on the car if it is written off.

The main thing is that you and yours are safe and not injured. Tell the Police about his phone. They can check if he was indeed on the phone (as you suspect).

That wasn't a 60mph impact, more like 25mph.

Irrespective, I would think your car may be written off on value grounds, but could be repaired by using a jig to pull the damage out and then fit a new wing, boot lid and rear panel.

I suspect the other driver is new to driving in the UK and with a RHD car.
 
And not in possession of a licence or insurance.
 
Sorry to hear that. Like previous poster says the car is fixable if you buy it back, but it willl be recorded as a write-off. Wouldn't bother me if I was keeping the car but will make it harder to sell.

Sorry to hear this. Another forum member in a crash, happening far too often. So many morons on the road! At least there were no injuries.
Hope you get suitably recompensed and back on the road with the minimum of hassle!

Firstly if they are 100% to blame they cannot write your car off, as you will be claiming off his policy you don't even have to contact your own insurance company, use a claims management company, they will have you in a hire car straight away, while your car is accessed / repaired, straight to a Mercedes approved body shop, if you want it written off then fine, just ensure you get it underwritten before they make an offer, otherwise you might end up with less than the market value.

If its written off its pretty pointless buying it back, you may as well opt to get it repaired, then trade it in if you want shot.
 
I suspect you will hear from his insurers very very quickly, they like to get in as early as possible when it comes to 3rd party claims to avoid costs from escalating.

And you will also be contacted by numerous ambulance-chasers / personal injury solicitors..... avoid at all cost.

Also, see if MB are willing to handle this for you - not sure if they do this for older cars.

He is insured and from witnesses they said it was atleast 50-60mph he hit at, and with brakes on we got shunted nearly 10 meters....


I don't think I would want it fixed, I have done research of what is available for sale from same year all have higher mileage... Even newer years have more mileage so I will be wanting atleast what it is going to cost me to replace with as close as possible, I have contemplated buying it back if written off and breaking it.
 
He hit you at 60mph and didn't break his headlights ?

I think the military would be interested in the glass they are made of ! Lol

Sorry to hear of what happened , I was rear ended a few years back , damage was comparible , it was at 30/35 mph.

I'd start getting some prices together for the inevitable battle with the insurer over value.
 
Sorry to hear this...main thing is you and your girl are ok, the car can be replaced, lives can not...
If you had been hit at 60mph the damage would have been substantially worse then your damage and sustained injuries.....the police will calculate impact speed when they mark and investigate crash scene, I think minimum undue care and attention for the driver...I am glad you both walked away.
