Handbrake not operating w211

Hi all,
I posted recently about the parking brake light not appearing in dash when i put parking brake on.

I had a suspcision that the actual parking brake was at fault, so i put the car in neutral, put parking brake on and the car was still rolling. Only bought the car 6 weeks ago from a private dealer and im pretty sure it hasnt worked since, can i claim from dealer?

The car is the E270cdi 2003 (w211).

Is this a big problem? Im in glasgow, so anyone reccomend somewhere that could fix it apart from the obvious MB.

Take it back to the used car dealer as is their problem as they sold you the car which should come with at least a 3 month warranty (minimum) unless you paid a lower price and agreed to no warranty. MB warranty will not cover this as a 2003 car would be outside the standard 3 year warranty period.

w211 could have had one for all i know never been in one .......
