How fragile are head gaskets?

I ordered, amongst other items, a head gasket from an on-line seller recently. Unusually I was at home when the delivery arrived, unfortunately the packaging was clearly damaged being S-shaped! I felt that fitting a head gasket that had been subjected to that would not be fit for purpose so rather than accept the delivery I asked them to return it to the sender.

Two questions; firstly was I correct in thinking that the gasket was knackered or are they quite rugged / flexible? And secondly, as I have been unable to get a response from the seller despite e-mailing and phoning them several times, how long would you wait before contacting the credit card company to claw back your money?

Get a genuine head gasket from MB if it is for your 124. Pattern HG's are crap.
 
It was genuine, just from a third party at what looked a good price. I don't mind fitting pattern parts generally but I only want to do this job once!
 
Ok. Head gaskets should be completely flat and not bent in anyway. If they are don't use it.

I have sent back a few before from MB that have not been up to standard.

For a part that is only £40 odd quid its not worth the risk.
