Is a split tie rod rubber boot an MOT failure ??

I just had both steering rack track rod ends changed on my Lotus Elise because one boot had split and the other was cracked. I was told that a split boot should not be an automatic failure, only if there was evidence of wear / slack in the ball.
 
My MoT garage (the one I use ) would fail it for that on the grounds that dirt can get in and wear away the joint.
 
An MOT tester has told me a split rubber itself is not an MOT failure.
Whether the ball joint fails six months down the line is of course not
the testers concern.

Warning only, unless signs of wear or play I believe is the actual ruling.
 
Well, the car passed the MOT with no advisory.I pointed out the splits to the tester before he started.
