Jerky gear changes?

Did a bit of googling, seems this is a common issue when the car is cold?

Can anyone confirm or deny?

Also I feel the car is wandering to the left, tracking is fine + tyres and pressures, also google says this seems to be a CLS characteristic?

I have a slightly older E320 with the 7 GTronic. It is a little harsh on the down shift between 2 and 1st when cold. its OK when warm and better in Comfort mode when it will only drop down to 2nd anyway.

Its fine on up-shifts.

If its done more then 37000 miles have the gearbox serviced the 7 GTronic is know for issues if this is ignored. Should be around £250 for a gearbox service.
