Just got flashed by mobile camera van. Can i appeal? Advice needed.

I live in a one way road, with access restricted from the main road except for cycles. This was done 5 years ago to stop people using the road as a rat run and i must say its worked wonders.

But you still get the occasional people still entering through the no entry so the council sends a mobile SMART car with a camera on the roof.

I never use the No Entry but today i had too. I was in a rush to see a patient at work but i left my case notes at home. It was raining cats and dogs, and the other end of the road had flooded:

I had no other choice but to go round the block and use the no entry as trust me, my w202 would not make it as its lowered! I could almost 100% guarentee i would have caused damage to my car and i didn't want to take the risk. There were 3 cars broken down there, i have pictures of them as well. I have previously had water enter through the sills on the SEC so am very cautious on doing through it as it looks shallow but is deep in the middle. Its a high pavement and you can see it submersed in water. There is also a dip in the road in the middle which isn't obvious in the pic.

The thing that annoys me the most is that the council dug the road up for a month last month to repair the drains and the first flash rain and it floods again!

Do you reckon i will get away with it if i appeal?
 
Worth a try mate. Or in you case a punt.;)

Tell them what you told us and plead that the water was the reason not a wanton disregard of the signs. Tell them that the blocking off of the road was always welcomed by local residents, crawl crawl etc and see what happens.
 
You should do really mate, but you know what councils are like...:(
 
Maybe. You are going to have to anyway to avoid a TS10, some points and a fine. I would get representation if you get a NIP.

Slightly confused by the picture, as it seems to show cars are using this road in both directions (see man walking with dog!). The road, or the junction at the top, seems also to be a "normal give way" point?

Anyway, I would try the symapthy vote, but as you went the wrong way up a one way street - shafted I think! Elements of reasonableness do seem to conjure in my mine, but Local Authorities do seem to have a lack of that !
 
I doubt you'd get away with it - you did drive through a no-entry sign after all. But if there was absolutely no way round the flooding (using side roads etc.) it is still worth appealing IMO as I think a conviction for this could possibly affect your insurance. I wouldn't use wording like "I was in a rush", though ;)

definitely appeal but you might want to get more 'evidence' eg depth of water, pictures etc all witnessed and timed/dated to support your reason for alternative direction. It cannot be 'illegal' to enter if there is an obstruction - surely ;) ?
 
Just spoke to the camera van guy, they don't issue points, they work for the coucil, its a £100 fine they think. They reckon i should appeal as they have had 13 other complaints today! They've made a note in their files to state that they've received complaints regaring this.

I have spoken to the council, they have given me a ref number and have agreed that they are aware of a problem in the road and they are trying to have it rectifyied.

I know its an illegal turn, but how else do they expect residents to get to their houses? They've caught 13 residents already!

The road in the picture is not my road. You have to enter that road to gain access to my road which is further along.

Its not a one way, its a no left/right turn into the road from the main road. Basically buses/coaches/cycles are allowed but thats it.

I thinks its unnacceptable if they expext me to leave my car there, walk through the puddle of water, get splashed by other vehicles and go home and bring the car at a later time when the water's died down.

Afterall its not the residents fault if the council can't stop the road form flooding.
 
You won't get a NiP for this, as you have already gleaned it's a civil enforcement, and what you would get is a postal issued penalty.

As the camera guys have already noted the "problems" it seems daft for them to continue to enforce, but that aside worth an appeal if complaints are (pardon the pun) streaming in.

Phew! Fines are easy, it's points that scare me.

In that case write a nice letter. If all else failes, £100 instead of a TS10 and 3 points is fantastic.

Isn't the key question still whether it was possible to divert around the flooded bit, and approach the end of KLP's road from the opposite direction? Assuming the answer to that is something along the lines of "no, it's a dead end road" an appeal is worthwhile.

I personally feel by complaining you have a very good chance of getting the ticket revoked.

Your first picture is very good, but I personally would not post the second. Nor would I mention you have lowered the suspension. It's kind of an own goal!

how can you get out of that one, you admitted you know its illegal .....you know the risk involved in lowering cars what with road humps etc now with road floodng i think your on a sticky wickit

I'm not going to mention that to them, i thought i'd give you guys my honest story.

I was aware of the turn being illegal, but as stated i needed to get to my house and it was the only way i could. Again i will not be telling them that.
