laguna been clamped

Just remove the clamp without damaging it and leave it at the side of the road. The DVLA doesnt own the clamp, the cowboys that do the contract work for the DVLA do. Providing you dont damage the clamp there is bugger all they can do. Ive had to remove 3 off customers cars and when questioned, ive denied all knowledge.

I wouldn't even worry about damaging the clamp : as soon as it is attached to the car , it legally becomes an 'accessory' bolted onto the car and therefore a part of the car and , as such , your property .

Effectively , you can consider it a 'gift' from the DVLA and if you choose to cut it off then that is up to you :D

They may be able to clamp the car , but south of the border , you folks have laws of tresspass and I'd imagine they broke the law by entering your private property without permission - see how that one smokes in their pipe :D

Oh , re the threat of stealing (towing) your car - once you have cut the clamp off , just move the car elsewhere so they can't find it , or put it inside your garage at the same address where they can;t see it .

Where *exactly* was the car parked when clamped?

You say it was on private land - can you be more specific?

on our estate there is off road parking carpark that is not owned by the council that is owned by the local housing commity for the estate

Hmm... well that doesnt really help you much as this will have public access and you probably can not deny them the impleied right of access. (the landowner could though by writing to the clampers)

Unless you can get the landowner on your side I thing you're going to have to stump up if you cant get the clamp off without damaging it.

Normally its as easy as letting the tyre down completely and then get a jack and a prybar and pry the chain over the now flat tyre.

If you can get the clamp off without damaging it and move the car somewhere safe then there's nothing the clamper can do. You have no contract with him and you've not damaged the clamp so he'd have to drop it.

If they take it and crush it you still have to pay a fine and then extra costs for them to tow it away and have it crushed. It most certainly wont be the cheap option.
 
if i could get away with removing it and not paying fine i would however seems that the fine is gunna get payed unless they take the car :(

Yes, he's right, you wont have to pay a release fee. :D

But you'll still have to pay the DVLA fine and if they tow it away and crush it you'll have to pay their tow charge and disposal charges.

Their in the business to make money remember.

there was no dvla fine to pay just the 260 fee's
 
Your car will either be crushed or auctioned. If auctioned, any funds made will be taken off the amount you owe for disposal.

much cheaper to carefully remove the clamp imho.

Sorry to hear about your car Chris. I'd be careful about removing the clamp to be honest as it maybe a criminal offence to do so, especially if it is damaged - have they put a sticker/sign on your car?
 
As already stated , I'd just cut the clamp off then make sure 'they' never find it . If they can't see it , they can't claim it was damaged and you have no duty of care over their clamp . They cannot prove that YOU removed the clamp so not much they can do . If the clampits are a private company you have no contract with them and no responsibility towards them . Just remove the car to somewhere they can't find it .

If you MOT the car and tax it , then SORN is cancelled .
