Lease Problems

Hi to all,

Can anyone help with a Legal issue?

We have a lot of Vito vans 23 in fact.
Most are on lease to our different outlets throughout the UK.
We have a nightmare with Mercedes dealers all the time from servicing to anything you can think of.

We have had no documentation upon the signing of a lease agreement (3 year 75k)
as to what is required on return of the vehicle. The paperwork or return requirements only sent out four weeks to the end of the lease period. We think some of the stipulations are a joke. Anyone ever had a fight over this? Any help appreciated.

MB Commercial Stealers really are useless - I have had more than my fair share of bad experiences every time with my Sprinter. We also made the mistake of purchasing a fleet of Mercedes trucks for our company as the after sales service is very poor.

I would not be surprised if they were to try it on with the lese agreement - it always pays to have everything in writing from the beginning.

I'm struggling to understand when the Lease's started....are they relatively recent or are you coming towards the end of the Lease.....which of the return conditions are you upset with?

Hi Thanks for the reply.

The lease of the vehicle in question is at an end.
The lease agreements say vehicles must be in good condition. That’s fine but they then send a booklet out, with what we want when the return the vehicle is returned.

For example a full MOT, even though the van is not 3 years old. They want 7 mm on the tyres. Most only have 8mm from new. We have contacted legal and they are saying they haven’t got a hope in hell of insisting on this. It’s just that nobody has ever challenged them before, or have they??

When I returned my E Class to DaimlerChrysler leasing at the end of the three years it didn't have an MOT (although I have heard of that being insisted on before) and the tyres were legal but certainly weren't at 7mm. Nothing was said.

There is a guide you can buy from BVRLA (the car one used to be online, not sure if you can find the LCV one too) http://www.bvrla.co.uk/public/Publications/top_sellers.cfm

Obviously your leasing company may not shave signed up to this, but I think it is a recognised standard. We used to use the car one for our company cars.
