New Drug-Drive Rules Come Into Force March 2nd 2015

New drug-drive legislation relating to both illegal and prescription substances comes into force in England and Wales on March 2nd 2015, a THINK! safety campaign has emphasised.

Purpose Of The Legislation

The purpose of the legislation is two-fold. Firstly, it penalises those that risk lives by driving while impeded by illegal substances such as cocaine and heroin. The Department for Transport has stated that the legal limits are set at “very low levels”.

Secondly, it recognises that some prescription substances can – if taken to excess or for illegitimate purposes – imped a driver's ability. Legal limits are set to “exceed normal prescribed doses”.

Medical Defence

Should a prescription substance put a motorist over the legal limit – but not to the point of impairment – he or she can claim a medical defence. On this basis, THINK! has advised any driver that requires medication at high doses to carry evidence that can be shown to a police officer. Examples include the prescription slip.

That seems to be suggesting that the best way to enjoy yourself if you know your going to drive would be to consume MDMA instead of alcohol or any other form of medication. :D

When killing a few minutes watching police reality trash TV I've often wondered, when the cops stop someone & discover cannabis in their car & cannabis on their breath, why don't they arrest them for driving under the influence?

Seems it would be a slam dunk.

Some forces state that a FIT test has to be conducted and not everyone has been trained to administer it………it has similarities to the US system many will have seen on TV shows. Current legislation is 'Unfit through drink or drugs' so such a drug user has to be at the same level of incapableness as someone who is drunk or on the way to being so, as it were. There is no numerical scale for drugs as there is for drink drive.

Imagine the lack of road rage.

Just think again,if I have a bottle of whisky in my car and I have had a literally a sip,do you really think I could or should be charged with driving under the influence?

The illegal substance is a different charge, possession. The cannabis on the breath is the same as my sip of whisky. Rightly it has to be proved that my driving was impaired. We still have to prove guilt in this country, thank goodness.

If Parliament wants to change the law to guilty for any alcohol/drugs in your system then it is able to do so,but lets not have new laws by the backdoor.

Are you being deliberately disingenuous?

I think you didn't in fact write what you thought you did. I have this problem,I can only read what is written, not what you are thinking. My fault, years of training in logic and law appeared to have killed my mind reading skills.

If you wanted to say after they had failed a drugs test, then why not say it?

Because I assumed I'm not talking to idiots.

My mistake.

I just won the bet with myself,I bet your next comment would be an insult.

Oh dear,I hope you are not an expert on anything as your lack of coherence will mean you will never be able to pass the information on. "Assume" makes an "ass" of "u" and doesn't inform "me".

Let's not have another long DM-style slanging match guys...hit a punch bag if you've got aggression in you...ad hom attacks on each other distract from the thread subject and are childish. Use your combined intellects to discuss the subject maturely. Thank you, let's move on.
