New owner woes

Hi,

I've now owned an E43 for 2 and a bit months. It is a Jan '17 model which had around 6000 miles on the clock, and I stretched myself to buy it using some inheritance money I had, which only makes things more emotional.
After around three days I got a warning in Mercedes Me saying 'starter battery critical' and a yellow battery in the display when getting in the car, so I mentioned this to the garage and got it booked in, although the earliest they could book it in was over a month after I bought it. In the interim, it never failed to start but I would get that message frequently, and either a yellow or red battery symbol in the display saying 'start engine, see owner's manual'.
When it went in, they kept it for four days then gave it back saying they'd run tests and it was fine, re-charged the battery etc.. I said it would have the message back in a few days and it did so I then returned it straight away to them. This time they kept it for nearly a week, and found an issue apparently with essentially an open circuit in the alarm system (the horn staying on - though with no noise obviously) leading them to replace the horn.
After getting the car back, I have had the yellow battery symbol in the display one more time but curiously nothing in Mercedes me, I think that it is holding charge now, and just doesn't like the short journeys I do in the week.
Having had it back for a week, I got a new message, a picture of a car with an up arrow, and the text Malfunction, see owner's manual. This I believe is a suspension malfunction, and the suspension was then stuck in sport mode despite the comfort ride being selected. So I have returned it again and they've had it all week. They've said they've found a problem with a damper (which I take to be the airmatic stuff), and ordered that from Germany so it will arrive on Tuesday.
Apart from this, minor niggles are that Mercedes Me often tells me that the windows are not up, even though they are, and there are rattles near one of the pillars and also on the dash behind the steering wheel.
Is this all normal stuff with a Mercedes, or at least the W213? I'm imagining I might have been sold a problem car (but I'm powerless having not had all the issues within the first month and none of them being particularly major), or just been unlucky, or maybe I'm being too picky (perhaps I shouldn't worry about Mercedes me errors or rattles though I have had plenty of cars with no rattles)? The dealership have had the car almost as long as I have during the period of ownership so far, with no offer of a courtesy car (when I asked they said they had none). On the bright side they wash it when they take it, and they do seem to be trying to solve the issues, and when I do have the car I love it, minor niggles aside.

Sounds totally unacceptable that no courtesy car is available, no doubt other members with more experience of new MB problems will advise you
 
Wholly unacceptable, presume you mean by the garage a Mercedes mail dealer?
 
Six thousand miles , 16 months old and it has all these problems ? I would get shot of it. Really it is obviously a Lemon, and the dealer you are taking it to sound as dodgy as the car. Bin them both is my advice.

I have an AMG , it's nearly 12 years old and has just under 1300000 miles on it. Do you think yours might live long enough to hit that kind of milestone ?

I know some will come back at me stating how 'analogue' and simple my AMG is compared to yours and I would say to them look closely at the posts on here where people have real problems with their Mercedes Benz and you will find the vast majority of them are practically 'new' cars.

The type of problems you are experiencing with your practically new 'prestige' car and your dealer should not be tolerated even if it was a 1.6 Vauxhall Astra.

Use the sale of goods act to reject the car.

It might be a problem car but one issue is too soon to tell. Battery issues cause all sorts of temporary issues on modern cars. I’d maybe ask for it to be changes and give the car 3 months to see how it goes. I’ve a s213 and it’s been faultless so far.
 
It only takes one fault in modern cars to cause all sorts of secondary issues, and they're hard to track down especially if you're just plugging in a computer and asking it what the problem is. Who are the dealership that are dealing with the car? Did you get an independent warranty or just a deal with the garage?
 
It's less than two years old, so I assume it's still under the manufacturer's warranty.
 
I would write a short timeline of what has happened so far and contact the Dealer Principal. Be polite, but firm and tell them that they have a limited time to fix the car, say two weeks, during which they will provide you with a courtesy car, and if it's not fixed after that time you are rejecting it and expect a full refund. If the DP says they don't have a courtesy car available suggest that you're happy to drive theirs while they catch the bus.

The service you have received so far is appalling.

BTW, battery issues WTF ?? you can buy a no name battery from Halfords that comes with a 4 year guarantee for £70. If this piece of 16 month old scrap can not keep its original MB supplied battery charged what hope for it's future. Stop making excuses. what is happening to the OP is totally unacceptable.

OP get shot of this car now. Sale of goods act , now called 'Consumer rights act 2015' is the hammer you have to batter this dealer into submission. a friend of mine used it to reject a brand new £14K motorcycle. He got all of his money back.

If you took out a loan or used a credit card for any part of the purchase , even better.
 
Is it a black one, reg EU17***? If so there is a good chance it was mine and I rejected it as it had sooooo many faults..... PM if you want to know more.
 
The OP hasn't been back since the time of his post. Make of that what you will...
 
Sorry all for not responding. No idea why I didn't get a notification of all your responses, thanks for them all. I do still have the car although it's back with them at present(Yes a main dealer, dartford mercedes) and this time they've given me a c- class whilst they've had it and said they'll vallet it and put some petrol in. The suspension was down to a wire not having been secured to the body work so it rubbed and wore through. One of the rattles I found was an early manufacturing issue which they've hopefully fixed. The start stop virtually never functions and they keep telling me it's normal after they charge it, but on the c class they've loaned me it works all the time so I think there's still a fault somewhere. They say they can't replace the battery (ies) without it showing a fault. No it's not black and it's a 66 plate, probably the first one built!
Not sure I can return it unless within the first 30 days?

Lol, a lemon it might be but I still love it when I've got it! It might be a problem child... thanks for your reply it certainly is a worry with so many issues so early on.
