Picked this up on PlanetSuperCar, extended for all W211 between 2003 and 2006 in the US after 50 alleged cases

Today I got a hold of the lead investigator and he confirmed that Mercedes sent a FedEx Package to their attention last friday. They will need some time to review the documents and post up the relevant info. They intend to post up a cover letter in the next few days

BTW here is the listing of documents uploaded to NHTSA Website which shows correspondence between the agency and the manufacturer.

US cars have a different filler system to support vapour recovery - this may well be associated with that fitment.
 
I had a fault where there was a strong smell of petrol in the car, I called MB, they took apart the rear seat and found the fuel sender to be cracked and there was a 30ml pool of petrol surrounding it. FIxed under my tier 1 warranty I had at the time. Potential fireball? It certainly scared me as there was 80 litres of Shell Vpower in the tank a few inches below.
