Refund on a Deposit of a Used Car

Hi,

I decided to buy a Car. On Friday I paid £1000 deposit (full price of car £5300).
I called my insurance on Sunday (today) They said they can not insure me on this car.
Can i get my £1000 back?
Isn't there a law that they have to give money back in a certain time frame? I have bought this from a dealer, not private. I have paid by debit card.

(i have paid £1000 of the £5300 only, and not taken delivery yet, £1000 was paid on Friday, refund request will be on Monday).

Legally, no.

It does NOT say "refundable deposit"

You still owe them £4,300, fail to pay and you are in breach of contract.

Practically, ask them politely, and explain why. Fingers crossed.

What is the car??

The Car is an 2002 Audi A4 2.0 FSI SE
I am age 22.
I was insuranced previously on a 1997 Benz C180 Elegance, but it was stolen and writen off.
So i am having a really bad unlucky period.

I did try other insurance, they said no.

My insurance company MoreThan said they can insurance me on an Audi A4 2.4 V6 SE
So i amused same car, smaller engine they will insure me.

And the dealer gave me a discount only if i bought it there and then

Try Confused.com, Go Compare or Money Supermarket. You will get insured easily on that car,you might not like the premium but I will be amazed if they won't quote you.

My dad is the first driver.
He has 12 years no claim bonus.
there are 2 claims.
15th May 2010 - Theft of Car.
28 May 2010 - Accident - 1 or 2 scratches on the alloy of a courtesy car.

My mum.
Accident 22 June 2007
Driver not at fault.

and me no accidents no points

Also. The problem with the insurance is, they cant find the Car.

The Car is a 2003 Audi A4 FSI SE 2.0L Multitronic (automatic)

When they put the registration it finds the car as a Turbo, which it is not.

Even on the insurance compare website, you cant find this car in automatic.

Are you the main driver ? If so given the above your parents are obviously fronting for you on the insurance. (You bought the car yes?)

This is illegal by the way.. and possibly the reason you are being constantly refused cover.

Double check the reg number - could it have just got noted down incorrectly? Or have a look at the registration doc. If the car exists and the only problem is identifying the car it must be a problem like this.

Are you sure it does not have a Turbo? not all cars make it obvious?

+ Moonloops comment. Get your NCB built-up and bite the bullet

So you're openly admitting to insurance fronting a public forum?

So it is your car but you insured it under your dads name and you were a named driver. Your now trying to do the same again! No doubt your dad is using his NCD on his own cars policy too.

The car will be in my mums name.

I dont know that you mean by fronting?

I asked the dealer he said its not a turbo.
I did A HPI check and it is not a turbo

Fronting is where the main driver is put down as someone of lesser risk (eg parent) to get a cheaper insurance premium. Insurance companies are wise to it, and on occasions will not payout. I believe it's classed as fraud.

If the car exists, then you must get to the bottom of it. Can you not just give the insurance the reg number to look-up on their system?

Fronting is using your mum and dads details (in this case) for your a car YOU are driving.

Which is illegal.
