One of the guys at school has just been booked £60 plus 3 points and the vehicle sized for taking the kids to a cricket match.

He has an old D1 licrence pre 1997.They call it a grandad licence.

He is paid in his contract/ salary to drive the bus.

Did he and the other drivers need a pcv licence as they do daily station trips.???

From what I remember of my days dealing with these matters so long as there were no fares paid by the passengers he would be covered under the D1 qualification providing there are less than 9 seats.

If a Minibus Permit (For carrying 9 - 16 passengers, is obtained from the Traffic Commissioner then charges can be made for the cost of the trip without resorting to a full PCV licence.

The journey must not be available to members of the public i.e. for the members of a group such as a cricket club. (It used to be called a closed tour but that may have changed).

It looks like your friend fell foul of the changes brought about when they changed the rules a few years ago to stop people hiring MPV's to get round the minibus laws.

Most organisations these days put the drivers through specialist minibus driving courses and have Minibus Permits.

I'm surprised the local authority doesn't have a checking system and driver training in place already, any LEA would ensure this to obviate finger pointing should there be any incident involving the bus that results in injury or worse to the passengers.

Hi there, the dvla leaflet INS57P states that the D1 entitles the driver to drive a minibus to a maximum of sixteen seats as long as its not for hire or reward. Assuming this chap is a school teacher or staff member then taking kids to or from an event would not be considered as being for hire or reward.

I too have a PCV licence under "grandfather rights" due to my past involvment with various transport museums.
I am allowed to drive any PCV under 2 conditions.

1, No more than 8 passengers can be carried (regardless of seating capacity)

2, No money can change hands (either fares or wages)

It seems from your post that he broke both of those rules (cricket team and paid)

That will be the reason for the £60 and 3 points, however as I understand the law, the vehicle will only have been seized if it was working without an operators licence or for a serious breach of the conditions of that licence.
