I don't know the full facts of the case, but I'm pretty sure this defence failed in the Crown Court at Manchester for one D. Yorke sometime around September October 2002.
I guess all that means is that there is no guarantee of success...but a lawyer would say that, wouldn't he?
I know from previous experiance that not identifing the driver leads to a £400 fine....
One of my fathers vehicles was caught, and we couldn't find who was driving it (honest). The court gave us the above fine instead That was for 41mph in a 30 zone.
