The Ongoing Loss of Revs and Kickdown Story

My '03 ML Cdi has been playing up by not revving past 3000rpm and no kickdown etc (only intermittently). I have been in and out of the car quite a bit today, and it has without fail started to work properly about 1 or 2 mins after i start it. Once it clears and starts working, it does not fail again until I turn the engine off then restart. I have pulled the maf, cleaned it and changed the atf along with the spacer into the gearbox. No difference.
I've had advice that it might be the egr. Does the fact that it seems to kick into life after a minute or two of driving suggest anything to anyone?

With expansion as things warm up yes,, the EGR valve or the flaps on the intake manifold,,maybe Black C55 can say something

Will It show as a fault on diagnostic?
