Transmission problems 2009 E280

What is the problem?
It's holding in low gears on starting up so I'm changing up using the paddles. It does get better when driven for a while and then the problem is just intermittent,ther is also a low whine.

What is the cars mileage ?
Has the car had a gearbox service and when was the last one ?
In colder weather the gearbox is designed to hold lower gears for longer to warm up faster .
It's done 169000 and was serviced 2 months ago
