Whistling noise (w202) C240

There is a strange whistling noise coming from under the dashboard, it comes and goes, but if i put the heater on, it stops. Its not the fan, it does sound like air whistling to me, Any ideas?

Does the A/C blow freezing cold? It could be low refrigerant level.

Oh, no as i had it checked, and i have a leak , it has nothing in it, so i suppose this is the cause?

If it is empty the compressor clutch won't engage, or at least it shouldn't, so it's not that.
