you may recall my thread about racing on a public higiway.

today i was found not guilty at harwich magistrates court

it is nice to see the system works and that i was not proscicuted for the offence i wasnt guilty of.

i still have a full clean licence and i intend to keep it that way
 
I remember the thread and am glad for your result. Pity the officers at the scene didn't give your explanation a bit more thought at the time, would have saved the tax-payer a lot of money!
 
and now said tax payer has to pay my solicitor fees shame really it was funny both officers didnt have a clue and contridicted themselves on Major points in their statements
 
Shilzo, having just scanned the original thread, would you mind sharing with us a) what the prosecution's argument was in support of the charge, and b) your defence?
 
the arguement was that we were racing

the defence was i was in my c200 following my friend in his 1.0/1.2 ( i cant recall exactly) toyota yaris i had no idea where we were going i was unfamiler as to the area i did not know of the destination.

Yes, I gleaned that the charge was that you were racing and that the main thrust of your defence was going to be that you were merely following the guy in front in an unfamiliar area from your original thread.

What I was getting at is how did the prosecution attempt to prove that you were actually racing, and how did you refute their allegation(s). Surely it wasn't as simple as just saying "I was following a bloke who was leading me to a destination I wasn't familiar with"? Or was it? :confused:
 
sorry it was meant as a joke, if you had been racing i would have expected your mate to be eatin your dust
 
Good to hear a just end to the episode. I bet you had a few sleepless nights over it though. I recall the thread and it could have gone either way as it was all really a matter of opinion more than something measureable or quantifiable like speeding or dangerous driving.
Sense prevails for once in this mad world.
 
this is what the majistrates said there were a number of charges they could have gone for with the same end results.

the main thing was they had no evidence all they had was the 2 officers opinion and what they think they saw. however they prosicution fell when the officers oral evidence was not the same as his statement.

funny thing is they same sargent also lost a case the week before because of the same thing
