Any MOT Inspectors here? Does an inoperative off side mirror constitute an MOT fail?

As per a previous thread about a 2008 E320 I looked at but requiring more specific input please :

The new MOT regulations state that an offside mirror is one of the obligatory mirrors and the new regulations also state that if "inoperative" this constitutes a Major fail.

Would "inoperative" in this context mean unable to be adjusted or is this another section open to interpretation ?

Also; any common causes of mirrors not adjusting from the switch or memory settings on the later W211?

Probably means if the mirror is missing. So long as it can be adjusted manually to suit the driver there is no reason for a fail. Not all vehicles have electric mirrors.

True but this one could not be (easily)adjusted, both I and the owner tried to move the glass by hand but it was not moving under moderate pressure and I did not wish to force it.

This the relevant part of the Regulations:

  1. Obligatory mirror or device missing.

  1. Obligatory mirror or device:
  1. slightly damaged or loose
Minor
  1. inoperative, excessively damaged or insecure

  1. Obligatory mirror or device not providing an adequate view to the rear

It's not an mot fail. It should pass no problem
 
You must check that all mandatory rear-view mirrors or indirect vision devices provide an adequate view to the rear from the driver's seat.

You don't need to adjust mirrors or devices for this check.

Indirect vision cameras may replace mirrors on some vehicles. If such devices are fitted, you must inspect the camera(s) and the screen.

Rear view mirrors and indirect vision devices can be any of the following positions:

  1. an exterior mirror or device that provides a view along the offside of the vehicle
  2. an exterior mirror or device that provides a view along the nearside of the vehicle
  3. an interior mirror or device which provides a view to the rear of the vehicle

Some garages will fail some will pass but under the rules if it has electric mirrors they should work or its a fail. Its unfair as not all have electric mirrors but its the same with a 3rd brakelight, if its there it has to work even though its not the law to have 3
