Mercedes MBUX Dashcam - Fraud

I am about to take Mercedes to small claims court over their refusal to refund me the £200 fee for their useless dashcam app. They are saying because it was over the 14 day period, they don’t have to refund me. I did point out to them that it took me about a month to get it working as I had to keep on buying different USB sticks and it only started working after their latest update but they haven’t responded to my emails.

My claim is simple. What they sold, dashcam, is not fit for purpose as it takes a couple of minutes to become available and I have to remember to press record, which goes against what is expected from modern dashcams which automatically start recording, therefore their product is not fit for purpose.

Has anyone else purchased the dashcam app, realised how bad it is and managed to get their money back?

However, I think that legally you are on shakey grounds here.

Your description of the fault is"... it takes a couple of minutes to become available and I have to remember to press record.." and that's certainly grossly inconvenient, but it's debateale whether it actually qualifies as 'not fit for purpose'.

Personally I would concentrate my efforts on claiming that you were never really given the opportunity to get a refund after 14 days, because the software didn't work until MB released an update which was one month later.

Alternatively, you might consider whether you want to engage in a Small Court Claim over £200, the other option being putting it down to experience.

I just coughed up the £200 quid for this, first off it does work but it’s clunky. The good thing is it’s using the existing front facing camera and the recording is of reasonable quality. The bad stuff is it doesn’t auto start and if you want to view the footage in the car you have to use the media player also you can’t see the video as it’s recording. I’m not requesting a refund but knowing what I know now I wouldn’t advise anyone to purchase it.
 
I would look at mis sold / misinformed rather than not fit for purpose.
