Premia solutions insurance - cosmetic damage and alloy damage cover is nothing but a missold product sold alongside new car At Mercedes Maidstone

Premia solutions minor cosmetic damage cover is a missold product. Mercedes Maidstone has sold me a product from premia solution which does not do what it says on the tin. They have declined a scuff bumper whilst the insurance contract clearly says it covers and even include scuff bumper under the definition of minor cosmetic damage . If anyone of you buying a new car at Mercedes Maidstone make sure you check that the insurance cover for cosmetic damage and alloy cover is not being underwritten by Premia Solution. I am willing to give evidence to support what I have posted on here today . I am escalating my complaint to the financial ombudsman.

It would be useful to see the T&C and the dealer's response, and try and understand on what grounds your claim was rejected.

Premia solution has used their own interpretation of the wordings of the contract by using terms that are not even in the contract “unpainted body work” not covered. They have also pointed out parts of the verbiage in the exclusion section which yet again do not explicitly exclude scuff bumper. They have chosen to ignore the defined term of “minor cosmetic damage which includes scuff bumper”. I called this reinventing the drafting of insurance contract.

So they claim that the bumpers are “unpainted body work”? Strange. Bumpers are most certainly painted.

Yes that is what they have put as their reason for rejecting their claim . I am also raising this issue with Mercedes Maidstone because they are indirectly promoting Premia solutions in the process of selling their cars.

Where is the scuff, is it on the painted or unpainted section?

If it’s the unpainted section then I wouldn’t be surprised if there’s an exclusion as it would be difficult to make good without replacement.

Who did you pay? The dealer, or Premia Solutions?

I totally agree if the contract states clearly under the exclusion section that this is not covered but it does not. On the contrary minor cosmetic damage includes scuff bumper under the definition section
 
I paid revive company who was outsourced to carry out the repairs out of my pocket as Premia solutions will not pay

I meant who did you pay for the insurance cover initially? Did you pay the dealer when you bought the car, or did you pay directly to the insurer?

EDIT: just saw your response. If the dealer sold you the product, they are jointly liable with the insurer. Start with the dealer, and don't let them wriggle out - they sold it to you, it's there responsibility. Try getting the rejection from them in writing.

Because I don’t like driving round with a scuff bumper. I just could not do it. It is nice car and I want to keep it that way.
If as a result of your complaint it is found that the insurance company should have repaired the scuff then you have taken away the opportunity for the reseller or insurance company to resolve the situation.

How long after being declined did you proceed with the work at your own cost, and how long after you knew the outcome of your complaint did you proceed with the work? Also was the scuff on painted or unpainted section of bumper? How much did The repair cost?

The ombuds man will be interesting in timing, because they are there as a last resort rather than alternative means if complaining.

Did it on the same day as the technician will have charge more if he had to come back. I am fighting this based on treated customer unfairly. I am convinced I should will this alternatively I am expecting Mercedes Maidstone to bear some accountability in this miselling as they know they are promoting premia solution indirectly

So you booked and completed the repair before the insurance company approved it? If that is the case then you may not get the response you’re Hopi g for from the Ombudsman.
