Yes by far m8 well thats what i thought over the years i have had fords never flickered but body's were crap thats why i went for merc the best so they keep telling me

So now you've got a van that rusts and with an engine which can't cope with urban use...
 
Interesting. A family member is currently looksing at a new Nissan Quashqai. I was browsing through the brochure and on the diesels there is an option to have an engine with a DPF or without.

There is a note below saying "cars with a DPF are not suitable for all customers. If your journeys are predominatly urban or low speed, a model without DPF might be more suitable."

So at least with Nissan you get a warning!

Thanks for that i been reading through the sprinter brochure and it just says all our vans are fitted with the DPF.
Think i will look at the nissan one and print it out at least they have covered there backs.
 
Don't quote me on this, but I'm pretty sure that you can remove the DPF.

If you do a forum search on this forum, it might show up.

Ok guys just to keep you updated, letter has gone off to MB Milton keynes just explaining what has been going on over the last past 3 years and i ned a face to face meeting with my solicitor they have 21 days to respond if not they are going to court.

Just to point out the main reason i am doing this is because (Bells Trucks) were instructed by myself that when bought the van i needed the van for window cleaning, so it is irresponsible by MB and Bells Trucks that i was not informed that i could not do frequent stops and not idle the van and i must blast it down the motorway.
MB keep on saying that this vehicle is for the urban user to and if that is true (which they say it is) we have a major fault with this van.

Sale of Goods Act, Faulty Goods.

MB Have responded and i have the meeting on the 26th

Good luck with your action, you will struggle with MB but keep going they ALL have to comply with the law

You will have a very good case, simply because 1) you discussed the use of the van and made the use a "specific term and condition of the purchase contract" even though this was only done verbally it is still a 100% legal and binding term and condition

2) your trading name, headed paper, busines card, cheques etc etc all re-enforce whatyou do as an occupation and the use that the van would be put to, they can not say they were unaware and in fact probably have a legal obligation to warnyou about your intended use and any issues that may arrise

I am not a legal person but did spend 10 years sorting customer complaints for a medium size company.

have been told by dealer to try and avoid short distance journeys and to drive flat out for 20 minutes every 5000 km.
Blimey I'd get locked up - our Vito (with DPF) does over 120 mph! :D
 
Just a quick update had the meeting with MB and Bells trucks and i think i am getting a new van :-) will keep you updated.
