Yesterday I got stopped in the road as a lad had been taken of his bike by a car. I didnt see the incident but i only just missed it as he was getting out from under his bike as i stopped to help.

i had a call from the police officer today to do a statement and i asked how the guy was.. he has a broken arm, fractured bones in his leg and a massivly bruised chin.

the guy didnt want me to call an ambulance at the time as all he thought he had was the bruise but he was walking baout saying i think iv broken my leg... i thought he was making it up lol.

ill be off to court i imagine if needed. poor lady was shaken up as he tried to bame her, even though he pulled out on her!

I was in a similar scenario a few years ago... but I was driving the car!

Adrenaline is a powerful pain suppressant... you can do some pretty freaky things when under the effects of a massive adrenaline shot...

Google "swedish sisters on M6".. actually, no don't google that :p click the link:

Warning, it's quite visual...

Apparently they both survived too!

if you didn't see the accident why on earth would you need to go to court?

Why did the police would need to take a statement from you?

thats a very good question that was on my mind.
perhaps we could go to court as well; yes thats absolutely correct your Honour we did not see the accident either - but we were quite close by when it happened......

Because all bikers ride around pulling wheelies and rolling burnouts while flicking the V to the general public with Crazy Train playing in the background

I lifted a 200 kilo bike from it's side up to its stand with a collar bone in 3 pieces, lovely wonderful adrenilyn.

Dave!

well i dint see it but the bike and car had been moved before the police had arrived.
after i spoke with the police man he claified the boy on th ebike pulled out.
but when they told me what happened it was clear the kid went past where the lines should have been and she hit him.

i dont actually know why i would need to go, but they asked me if i would.

but hey more the merrier :D

Absolutely nuts

You wouldn't make a very good witness, to be blunt, seeing as you didn't witness it, but what do I know :)

Strangely enough - you don't have to witness the incident to be a witness.

When I collided with the biker, the main witness in my court case (driving without due care and attention) was the policeman who arrived 30 minutes AFTER the incident (we called them... and an ambulance)...

The main witness was NOT the lady in the car behind me, who had seen the incident unfold from start to end and who stopped to help. She couldn't come to the court case and sent in a statement instead.

I didn't understand it either... but hey, I'm not a lawyer :)

"You have been asked to go to a magistrates’ court or the
Crown Court to give evidence as a witness. You have been
called as a witness because you have made a statement
tothe police about a crime and the court may want to ask
you about it. Or, you may have been asked to give evidence
for someone who is accused of a crime. "

From reading this document a court witness does not have to be someone who saw the event, e.g. a Doctor called to testify on the medical condition of the accused would be a witness.

That's certainly true.

Driving in heavy rain some years ago, I saw a youth as he bounced off the bonnet of my van.

(yes, I know, Jasper Carrott said the same - but this is honestly true!)

Before I (and a motorist on the other side of the road) had got out to see if he was ok, the injured party ran off at high speed!

Obviously I and the witness went to local Police station to report incident etc; the Desk Sgt said he would check round the hospitals etc for the injured lad.

2 days later I returned (with insurance dox - Sgt was making sure every angle was covered) and apparently the lad must have only had bruising... as no hospital had any records of admitting anyone with the kind of injuries he might have had. I still shudder to think how different things could have been if the post of the wipers had contacted his skull - we all thought that he was injured and running on adrenaline, but his lucky angel was on his shoulder that afternoon.

As the Desk Sgt said.... "usually, in a Hit and Run incident, it's the driver that runs, not the pedestrian!"
