Crash in narrow lane

I'm driving along, a big white van appears from nowhere, I swerve out of the way, hit the curb and just miss him, and then he just keeps on going, I stopped some little way down the road for a breather when the white van camper pilot appeared and came out guns blazing, blaming me for scrapes on his van, bit of a rumpass, but eventually exchanged details and shook hands.

I've come across evidence that the damage to his van is 6 months old:

Looks like a clear summer sky to me. Also, if you look at the pictures of the motorhome the trees have leaves on them as though it is summertime and there's a chap wearing a polo shirt.

So, what is it you are trying to say?

I'm confused (Doesn't take a lot).

What were you driving?
What was he driving? (White van in the pictures)?
When were the pictures of the white van in the pictures taken?
Who is euromerc (Nick), is that you or him?
If that is your campervan in the link pictures, why is the o/s mirror folded in? Is it damaged?
Was the mirror on the white van damaged?
What evidence do you have that the damage to his van is 6 months old?
Was there evidence of white paint on your vehicle?

The scrapes on the white van look as though they are down to the metal in places, surely it would have shown signs of rust after 6 months?

My first instinct, without more info would be that one or both were driving too fast to stop (obviously) and for the type of road and that it would be seen as a knock for knock claim.

Pity you don't have just one witness who could testify that he failed to stop after an accident at least. I don't suppose you reported that fact to the police by any chance?
 
I saw this van with my own eyes about four week ago and it didn't have the damage it does in the photo now.
 
The EXIF data on the photo says the photo was taken on January 6 2012, it also says 2.52am! so if it were accurate I would have thought you would have needed to use the flash!

I have a small digital camera that eats batteries so I insert a plastic strip between one of the batteries and the contact terminal until I want to use it. If I want to take a picture quickly I don't bother with setting the time & date, so many of the shots I take with this camera show as being done at midnight on the first of December, 2006.

I called the police, the police didn't care, the insurance company said that people just driving off is very common, and that the police aren't really bothered.

I had witnesses galore, but because I had to go hunting for the missing camper I left them all behind.:wallbash:
 
In fairness to Nick, the date/time is all from the camera, so if that is set wrong then the picture info is wrong.

I been there myself, bought a second hand camera at the start of the year, and took it with me with my other one. My other one had the correct time, the other, well the wrong time messing up my photo library...

It won't matter for the insurer, they'll see the files creation date and only concern will be resolving this.

Depends on the value damage to Nicks Van, if its high, they'll want to contest it so they are not out of pocket. Damage to Nicks wheels, the damage to the van would indicate he was ran off the road by the camper, and it it was marked as an unsuitable road for large vehicles (which the camper is) I think he is in with a shout if he presents all this information to the insurer.

- it would be foolish for the camper to suggest he didnt know with all that damage to nicks van
Also that old camper doesnt look in perfect condition
Its roadworthiness could be questioned

That plus unsuitable for that narrow lane suggests a good case

I think its overwhelmingly in Nicks favour, insurers are funny beasts and repanneling a van won't be cheap, they will not want to pay.

Leaving the scene, the road signposted as being unsuitable for large vehicles, the wheel damage to the van showing it couldn't get any further over....

All going in the campers fault
 
You're joking right? With no witnesses, the caravan driver will already be claiming whiplash and that he was still when Nick drove into him. 50:50

The camper driver can well claim that he was not the guilty part and that Nick was going to quickly, blocking the road etc. Did he leave the scene? Moved to place where it was safer to stop. Concerned that this guy was chasing me. Not aware that I was involved in any kind of accident etc etc.

My money is "knock for knock"

I would like it not be but this is my experience of country lane shunts.
 
It was the other guys fault!
