Hi,

Just really need some advice. I bought a used 2012 SL63 last Thursday from Inchape Mercedes dealer in Liverpool. I've been having problems since then. I'm from London, so drove up the night before, and stayed in a hotel. On Friday morning I went to take the car. I was very happy with the condition, we went for a very short test drive, and nothing major showed up. On the way back to London I noticed a few problems with the car.

1. Tire monitoring system failure warning light on dash.

2. Very loud wooosh noise coming from the passenger side (sounds like an air compressor issue)

3. Stop and start system kicked in, but once I lift my foot of the brakes to go, the car stalled, I had to restart the car manually with the key.

4. Coolant low warning light came on.

5. The spare key didn't work

6 Rattles everywhere

After spending nearly £50k I was really ****** off. Called them the next day, and they said the car was fully inspected by their workshop beforehand, and no issues were found. :mad::mad:

They said they're going to collect the car and drop me off a loan car while they fix all know reported problems. This morning the car was collected and a loan CLS was dropped off. As I really love the SL, I thought as long as the car comes back to me fixed I'll drop all complaints.

Before I bought the car I asked the sales man how many owners it had on the logbook. He emailed back saying 2 previous, I then replied saying it would be a big problem for me if the car had more than 2 previous owners, he replied back saying you would be the third owner on the log book.

Go the log book this morning, and behold it had 3 previous. Which means I'm the 4th owner:fail:mad::mad:

I now don't want the car anymore, because all they've done is lie, and lie some more. I want to get my money back and go somewhere else. I've emailed them saying so, but want to know what to do if they try and put up a fight?
 
If you bought it as an Approved Used car then you can reject it and get a full refund in the first 30 days. It's doubtful they'll be awkward.
 
IIRC if you buy from an authorised Mercedes dealer, you can return the car for any reason within thirty days.
Including if you just don't like it.

Whilst the other issues may be fixed, rattles are harder and would drive me mad.

Did you buy it over the phone and then go to to collect it?
Or did you go look at it to buy then go again to collect?
Reason I'm asking is that, as well as what's been said above, distance selling regs would apply if you bought it off their premises.

I bought it over the phone, I then picked it up 10 days later.
 
In that case I'm pretty sure distance selling regs give you the right to reject it within 14 days, regardless of any merc offer.
With the 2 things combined I'm pretty sure you have a case.
Enforcing it might be another issue though.

One last thing. Don't suppose you paid a deposit by credit card by any chance?
If you did, you'll be able to go via the CC company for a refund too.
I'll keep an eye out for you on judge Rinder if it doesn't work out.
 
I p/ex my BMW M5 and added some money on top for the Merc.

What would happen? Do I ask for my money back, or do I ask for my M5, plus the money back?

I would rather get the whole money if I could, as don't really want the M5 back after they've had it in their possession for 1 week.
 
Reject the car and ask for your money back in full. You sold them the M5, you do not have to take it back.

Call the dealer and start the process asap.
 
ball is in your court but it's prob easier to work on getting another car they have in stock rather than money back just like that.
 
They want to give me back my M5 plus the difference. I'm not happy bout this. It's not my fault I had to reject the SL. What options do I have?

It's not your fault. But One assumes the law on this says they need to put you in the same position as before the deal happen. Depending on how the deal was transacted, I imagine your car was a trade-in against their car, not bought for cash. Them giving you all cash would be seen by most to mean you are ending up in a better position than before the deal started.

So if the deal was your car plus cash, you get your car plus cash back. I suspect they will stand firm against giving you all money. The last thing they will want is for you to walk away with their cash and them end up with TWO cars to sell.

Seems reasonable given the circumstances.
Far from an ideal situation, but what more did you expect?
 
Thanks. I do understand, but the hassle I now have to go through in order to collect my car.
