I THOUGHT THE HEAD HAD GONE ON MY MB W210 M112 SO I WENT TO MERCEDES AND ORDERED THE BOLTS HEAD GASKET &OIL FILTER £114.25 I LATTER FOUND OUT IT WAS THE OIL COOLER FROM MEMBERS OF THIS SITE.SO I ORDERED THE OIL COOLER £90 PLUS VAT CAN I RETURN THE GASKET'S AND BOLTS ???NO I WAS TOLD FOR US TO DO THAT YOUR ORDER MUST BE OVER £150 I ASKED TO SPEAK TO THE MANAGER WAS TOLD HE WAS OUT PHONE BACK IN 1 HOUR THAT I DID TO BE TOLD THE SAME CRAP SO NOW I AM LEFT WITH HEAD GASKET'S AND BOLTS THAT ARE NO GOOD TO ME I NO THIS WAS MY FAULT BUT A COMPANY THE SIZE OF MB OVER £114.25 :devil: .THOUGHT'S PLEASE

There's no reason for them to refund any face to face transaction, especially as they've ordered them in, MB won't take them back.

In terms of MB parts policy no as they operate using a vehicle not present system and if they havent checked the parts then it's not their error. However, as a consumer you are within your rights to return goods if they are in sellable condition. So if the manager wont give you time of day, try with the dealer principle. If you need to make a very big deal then do so and see what happens. Good luck.

However, as a consumer you are within your rights to return goods if they are in sellable condition.

There is not right of return for face to face transactions, ie buying something in a shop or parts dept.

Some shops do offer a returns period Argos 28 days for example, but that's their own policy and you cannot force a shop to refund you if they do not have a returns policy.
 
It will probably say no returns on stock order items on the invoice. As people have said it is their policy and perfectly normal practice.

There was a big sign to this effect in the parts dept at Whitefield MB. I told them this sign was illegal as faulty parts can always be returned whether they were specially ordered or not and trading standards take a dim view of this type of practice. The sign never went down and I never did anything further about it.

Don't MB parts come with a 2 year warrenty anyway?

If the goods are faulty then I believe they have to refund/replace as they are not deemed to be of "merchantable quality". This is part of the sales of goods act.

In this case though i can understand why they are not returnable. Someone will have to check them before they are ready for resale. Would we really like to buy spares that have previously been taken away by other consumers? I know these items are not likely to damaged but where do you draw the line?

Why not advertise them on here to see if anyone wants them?

Apologies for any confusion but I didn't mean I had bought items which turned out to be faulty, I just told them in passing that the sign was misleading! :)

I ordered them on the 12th of April this was the start of the Easter holiday;s i did not receive them till the 17th of April so if you CHECK my post was the 17th of April i had them then. So you should get your facts right before you make a comment like you did about a member and slap Ur Owen head not mine like you did in the post. It was someone that told me about this site and that is why i posted on If i had been told to check the cooler before i had made that order i would have as i always check thing out first one guy told me the cooler was ok another said it was knackered. so i took it to a mb mechanic and he got it tested and told me it was done

The MB dealer does not have to give you a refund as in legal terms terms all goods are sold within the term used as "invitatation to treat" they advertise it and you buy so to speak, they dont force you and you as a consumer have a choice whether you buy it or not, if you agree to purchase the goods over the counter then you handing the money over is forming a "contract". That contract is binding the seller and purchaser, you can only renege on this contract if the goods are faulty as someone has pointed out above. The only time the above does not fully comply if the goods have been bought over the phone or online, at which point the "distance selling laws" apply and that gives you 7 days. the only way round is to apply to the general manager for a discretion or gesture of goodwill in a diplomatic fashion with plenty of please and thank you and who knows......

I had one yesterday along similar lines, only shipping is £85 each way, and they want me to sponsor it...
 
no i have wrote it was my fault not the parts department but i am retired age 64 not a lot of money as other member said a goodwill guesture would not hurt mb pocket even in these times

It is entirely up to them. I have bought parts at cost from MB as they were desperate to get rid of old stock and on at least one occasion I took items away for nothing as they were incorrectly ordered and the parts guy said they would be going in the bin otherwise (wiring harness - I wanted the plugs off it).

you had ONE yesterday oh i see you mean you had a customer ?? this would not cost mb nothing goods not opened still sealed they could resell them .a lot different from yours?
