Low speed surges

Hi all having problem with my CLK220 2007. For few weeks now driving at low speeds 30 to 45 mph the gearbox changes can change from smooth to sharp and at 43 mph this surging starts Under load at the same speed it goes away until you hit the flat road then starts again just had an EGR valve as started to fail. Any body have an ideas

When was the last time the fluid was changed in the box?

Oil was changed at 33.000 now on 45.000

Shame. - I was hoping that recommending a fluid change might fix it, but I don't think that's old enough yet (although I could be wrong).
Was it definitely the correct specification?

Any fault codes?

Well that's something else it was done by an independent MB tech before I purchased it. Might get it changed anyway. Also thinking of replacing the MAF sensor as I don't think the surging and gear box are linked. Also noted it don't surge when cold !!
