Hi I bought a second hand 2017 350d in July 2022 with 37000 miles from a large independent dealership not mercedes just before Christmas without warning the car ground to a halt on the road I had the car recovered by a local garage from the roadside to discover the crankshaft had siezed solid I contacted the dealership I purchased the car from I would need to get the car recovered to them to inspect as the warranty they gave me with the car only covered up to £2000 I had the car transported to them in January as they were 4hours from me upon striping the engine to determine the cause which has taken 6 weeks and allot of calls from me they have had an alleged Independent technical report they state the damage was caused by lack of lubricant but also Confirmed there are no oil leaks and have stated although the car was well filled with oil we had driven the vehicle with low oil and with the oil light on therefore we had filled it with oil prior to bringing it to them. The garage who recovered the vehicle have Confirmed with me the oil level was correct when they brought it in
This car has never been low In oil since I have had it and the garage I purchased it from apparently gave the car a full service at the time of purchase with me having covered 5000miles since
I know this report is false as from day one the garage did not want any responsibility for this
and said if its driver error its not covered
 
Lack of lubricant can be a few things , low / no oil or oil pump failure.

Can they prove you topped the oil up before they received it ? , if you had put fresh oil into an engine and not run the engine it will still be fresh.

Have they checked the oil pump is not knackered , or is this info in the comprehensive report ?

If they serviced the car and it had no leaks how can it have been ran with the oil level low enough to seize the crank in just 5k miles ?

Do you have a copy of said report , if so who carried it out ?

Who was / is the warranty with - dealer or aftermarket - and were is it stated that the repair limit was £2k ?

You have statutory rights which state that any fault arising within 6 months of purchase from a dealer is their responsibility and must be covered by the dealer unless you were notified of the fault at the time of sale.

Those rights do extend to 12 months but it then becomes the responsibility of the owner to show those faults were present at the point of sale.

Look up the provisions under the consumer rights act 2015.
 
So you had the car less than 6 months before it broke down?

If thats the case, regardless of any warranty, your statutory rights state "If a problem is found after 30 days, but within six months of purchase, you can request a repair or a replacement vehicle. The onus is on the seller of the car to prove the fault wasn’t present when it was sold; if they can, and you’re likely to have known about it, you won’t get a refund"
 
Thinking about this.

If, as the the garage claim, there was a low oil warning light would this be stored in the ECU and therefore they could provide proof that this occurred?

This has the sound of complete BS from he garage and I would be challenging them in Court via money claim.

Does anyone know will the ECU unit store that information, to prove the oil level or the pressure light never came on?
 
Hi Donna . Hello and welcome . But the fact is you bought a car from a dealer and the that car has now broken down while still in a period of 'warranty' . The people who sold you the car are your first point of contact.

We will help you all the way . But your first point of contact is the people who sold you the car.
 
Oil starvation at the crank - quite common on 350d engine, same happened to my mates gle 350d.

Please tell me this is joke! My GLE coupe did exactly the same thing at 24k miles!! Please read my thread!
