    They would still pay out if your car was in the garage. You are better off insuring the car as being on your drive because if anything ever happened and it wasn't garaged the insurance company could possibly reject the claim whereas that wouldn't happen the other way round.     It wouldn't go to county court it would go to the small claims court because of the amount. Now if you do refuse to pay and the DVLA take you to court route beware.
