2019 e63s w213 prop shaft snapped!!

this is my 1st time posting on any threads like this. so i am very new to this.
i would appreciate for your input in my case.

so i have a broken prop shaft on my car i bought it about 2 month ago the car only had 14k on the clock very good condition 1 owner and the car still under manufacturer's warranty i have 17 months left on it.
in that 2 month never had any issues was running very good as it should.
3 weeks ago as i was turning into a street at a very low speed i heard a banging noise under the car and the car was struggling to move so i stopped the car immediately and called roadside assistance.
later that week they send me the health check video and i have attached the screenshot as you can see its not looking good.

so they have had the car for 3 weeks now they have done many checks to find out how this had happened as they told me "this is very very uncommon" and they called me today and telling me many things needs to be replaced which they have been advised by AMG UK team. they have told me i need to pay 10k for the repair work on the car and i told them the car is still under warranty they said "yes we know but this is just for insurance incase its not covered" and i found that very strange and not right.

so please guys tell me what you lot think about this.

and if any other information is needed let me know i will try to provide it.

That looks like it has twisted apart so massive power from one side against an immovable force the other side. Looks like someone has been putting their foot on the brake and whilst revving the engine for race starts?

No race start. I was turning to a street when I lost power and heard cracking noise under the car. It was just very strange how it had happened.
 
Do they mean you pay £10K which gets refunded on the repair? Never heard of that before. I would certainly not be paying anything.
Yeah they said the 10k incase I am not covered under warranty when they have had 3 weeks to know that already.
 
So the car is at a MB dealership and they are asking for 10 grand just in case the repair is not covered,if so I would not pay anything upfront,let AMG sort it.
 
What roadside assistance did you call and where did they take the car?
Whereabouts in the UK are you?
 
A £10,000 propshaft. How ludicrous. If you have had the car for only 2 months i would reject the car and get a full refund, if that is within your consumer rights.

Yeah at the main MB dealership. Apparently that's what AMG have said to the dealership where my car is.
 
@ar63s Sounds like they suspect that the damage may be due to the way the car has been driven (which would not be covered by the warranty), rather than a manufacturing fault. I'm not saying you've abused the car, but maybe the previous owner did?

It's not just the prop shaft they said few others things needs changing I can't exactly recall what it was. Also I bought the car at a 3rd party dealership and for my consumer right was only for 30 days so I very much doubt the full refund.

It doesn't take much labour time to change a propshaft. You then have the centre mount and bearing and the flex discs. A £10,000 bill must be factoring in a replacement gearbox and/ or differential.

As for your consumer rights i am sure someone on here will be able to tell you more.

Yeah I kind of thought that too but when I got the car and for that 2 month of having the car been running going and the previous owner as I was told hardly drove the car but couldn't tell you about his driving. Myself I do look after my cars especially this one eveything I have done is done at the dealership no matter what type of work. Always stick to the manual guidelines that being petrol, oil, tyres and always warm the car up 30 minutes or more before driving it.
 
Consumer rights under law apply to all car traders.
Warranties and other terms and conditions are there to protect the traders & dealers and to try and let them pretend they can wriggle out of their liability under law.
E.g. we won't cover this under the warranty......
(but we are not telling you that it is your right under law that we should cover it anyway, so we'll wait for you to raise that point with us and potentially fight you through the courts defending your rights under law).


30 days rejection without quibble.
Car has to be fit for purpose for 6 months from sale and any (pre-existing?) faults, you have to give the supplying dealer the opportunity to repair/replace/refund I think.

@ar63s I see. I do hope you get this sorted (at no cost to you) - sounds like it's unusual fault and it's just a case of you being unlucky with a used car

They didn't mention anything about the differential in the health check video was said " at a very good condition"
Tbh I don't want to give the car back because I really like it and is very clean car. Will see who can help about the refund process.

Yeah I had some issues with a range rover that also needed £9k work done on the car it happened after the 30 days but i needed up the company who i bought the car to pay which took over 8months of calls and emails fighting them to pay. My finance team fought it for me and help me. But at this moment of time it's too early for me to start this process yet. I am just waiting on the AMG team to give me a call as I have requested. I will definitely keep you guys updated on this case.
 
Understatement to say this is bad news. If it were me I would be looking for some proper legal advice. I definitely would not be paying any money to the dealer in a hurry. They have already had the car for several weeks and unfortunately this looks like it may take a while to resolve.
