Please suggest/advice..!

I bought the approved used car from the MB dealer 2 weeks ago, but car have some technical & mechanical problems,
1. Car Engine making some strange noise while running, noise is too high from cold start, & while pulling off.
2. Gear transition are not smooth & change the gear with jerk.
3. Car not as responsive as it should be, while pulling off its lags it doesn't pick up well.
4. MPG are very low.
5. If rev the engine to a higher rpm while stationery, its making whistling noise.
6. Standard accessories are missing.
7. Now and again i get this error message on the dashboard (Vehicle not in position P).

Unfortunately, some dealers will not PDI the vehicle themselves, selling it to the customer on the basis that they will repair faults that are spotted. Take it back and report the faults, calmly but expressing disappointment that it was sold this way.

How old is the car, how many miles has it done and what dealer was it bought from (independent or Mercedes)?

visited the local dealer for quick check, they said car is fine, but with statement on all the points was,
you will not achieve more than 45 mpg on urban drive.
car will legs 1-2 seconds as engine is in front & this car is rear wheel drive
car gears will get smooth after some times.

the dealer sold the car has picked up the first word that car is fine & refusing to do anything.

So it's still in warranty and it's a Mercedes dealer.

Don't you have a 30 day period in which you can reject the car for any reason whatsoever?

In which case, I'd drive it back and say I don't want it anymore I'd like my money back please.

Then watch how fast they put things right.

yes that's correct, still with in 30 days & under 1000 miles , but dealer replied "have no grounds on which i can reject this car"

i have seen this terms & conditions but still dealer refusing to exchange the car.
do i have any legal stand? is any consumer protection or rights..?

It's quite clear that the exchange is "for any reason" so I think it's quite clear you have a case.

If your dealer won't play ball, call Mercedes head office in Milton Keynes. It would be prudent to put something on an email so it was at least date stamped to prove you're within the period.

i have sent email to dealer last week with all the issues.

45mpg would be exceptional for wholly urban driving. I get about 36 out of mine on my daily crawl across London.

Sorry..! correction they said on motorway (it mean extra urban) company specification is 67 mpg.
surely its not acceptable, as its nearly 35% less than what they stating on performance data.
Performance Data
Number of seats: 5 Max speed (mph): 141
CO2 (g/km): 129 Cylinder arrangement: Inline
MPG (Urban): 45.6 Cylinder count: 4
MPG (Extra Urban): 67.3 Fuel Delivery: Turbo
MPG (Combined): 57.6 Number of gears: 7
Acceleration (0-62 mph): 8.4 BHP: 170
UK tax band: D Torque (lb ft): 295
12 month RFL(£): 110.00 Euro status: 5

36mpg is what ours is producing on motorway runs. It drops into the 20's if I drive in town.

That seems low. I push on towards mid-forties and as high as fifty on a run up M1/M6 to Warrington via M6 Toll.
It's fair to say that the 67 quoted in the official figures is the stuff of fairytale, as has been covered extensively elsewhere on here.
