I'm a bit worried by this "No major rust on car any spots are maintained by auto glm shampoo and polish" which would imply that there are rust spots on the car.

I don't know if you'd be able to take it to Merc to get the rust seen to under warranty. Even if you could the biggest stumbling block would be the lack of evidence with regards to service history. We all know how obtuse they can be, even if you shove a whole sheaf of bills and paperwork in their faces.
