Traders stating "spares or repairs" or "sold as seen" are committing offences and should be reported.

Used cars come under the new Consumer Rights Act so talk of warranties is a moot point.
 
Traders do this regularly because they know (a) majority of buyers don't know their rights and (b) very few will actually follow it up with trading standards if needs be.
This seller knows he can ask for a good price for an AMG but also knows if something fails in a month, he will lose most of his profit hence the relinquishing of responsibility
 
Just been through all this myself !! Whatever they say does not affect your statuary rights, I'll try to sum it up without making a three page article.

I bought the car, developed a fault within 30 days, dealer (Smart Motor Company Brentwood) took it away claimed they performed a repair, ATF Change, got the car back fault developed again, dealer denied resposibilty trying to state i didn't take the extended warranty offered and also tried charging me for 3 litres of ATF @ £35 per litre !! I took the car for diagnotics and ended up having to pay £795.00 worth of repair work, it was also uncovered they the dealer had not changed the ATF at all ! I then began claiming everything back following the advice of trading standards.

I should receive the payout for the work carried out this week after 3 months finally ! It has been a total nightmare and the worst thing is that the dealer appeared to nice and done everything with a smile while lying through his teeth from start to finish. He could not produce diagnostics, he could not provide an invoce for the "repair" it probably sat on his drive while he waited for a mate to clear the codes trying to get me out of my Statuary rights.

There's a lot more detail to this but i'd have to start a new thread lol !
 
Ditto I have only experienced 2 honest dealers in my time buying cars, my wife has just purchased a Honda Stepwagon fingers crossed it will all be ok. I hate buying used cars from dealers, there are good ones out there, it’s just trying to find them!

I've only ever found 1, i bought two cars from him within the space of a month niether ever developed a problem and were exactly as described.

I've have had to have the work carried out on other cars and claim back the money several times 2 of them (this one included) i've sent out a summons to small claims court.

My first experience ( i think i was 25) was when the brake lines failed on my ex's BMW 3 series the dealer tried double talking his way out of the invoice on every turn (months) so in the end I sent him a summons to a small claims court and a cover letter detailing his emails, telephone conversations, and a report from the garage detailing the work done to bring the car to fit for purpose use.

On both occasions i gave them every oppertununity to put it right and waited months, them probably hoping i'm going to go away and give up till they get a letter saying we'll let a judge decide....... i just wish it was Judge Dredd !!:rolleyes:
 
My Wife bought a car from a Garage in Peterbourgh, it developed a fault on the way home, Took it back and got surrounded by the garage employees who intimated us, So we took it back home and got it repaired at our expense, the warranty was useless.

"2nd" one was bought from a Garage in Clacton developed and fault as we pulled off the forecourt ,I Reversed it back asked to speak with garage owner who got all aggressive made my wife cry etc so again we took the vehicle away and traded it in at a Main dealer.

She's needs a reliable car we have 2 sick children hence require large ish people carrier/s, These dealers play with people's live's and dont realise that even a £5k or 6k car can course hardship to the purchaser/s.

I'm lucky enough tobe in the parts trade so can get bit's n bobs sorted at smaller than average expenses, Next time we will take court action if needed, Cant keep letting scum get away with selling dodgy cars. It's just more added stress for myself and wife who are already under added pressure. :(

Its sad to say but the warranty companies are as dishonest as the dealers! Obviously not all dealers but definitely most warranty companies!
 
Does the government really force car dealers to warranty a 14 year old car? That sounds ridiculous to me.

You have a lot more consumer rights than you think you have. Cars from dealers must be sold fit for purpose as with anything and 30 day consumer rights warranty is there to protect the consumer from such "dodgy" or "bad luck" sales ...... BUT ! it is time consuming and far from easy to claim and the best advice i could give is check out the dealer on the motor trade ombudsman's website before purchasing because you'll have more help should you need it and Citizens advice / Trading Standards was an amazing help. Not motoring related but i even got a 4 year old microwave refunded ( vouchers ) from Argos after a months of emailing as your covered for 6 years under consumer rights on electrical goods did you know that ? i do and now the Argos Staff and manager in Hayes does too :) It's effort to educate them but for a £200 microwave it was worth it :P

It was far from easy but persistance and down right stubborness and my absolute for my hatred of bad customer service and being lied to usually prevails.

That's Bloody awful Gavin...sorry to hear you've had these rotten people...on another note one of my sons has a run in with this sort when his girlfriend bought a car, again piece of auction crap. He ended up dusting two of the people who tried it on ...he said it felt good but he's ended up losing though as he now has a record, 6 months suspended for 2 yrs , all caught on their CCTV ..ha ha blinking idiot. ...you did the right thing Gavin!

From a practical, business application, I don't see how that's reasonable. There is certainly an argument that if the car was nearly new and with low miles because the manufacture can back this up, However after a certain age and certain mileage, it's impossible to guarantee a car especially if it happens to be a 14 year old supercharged Mercedes with ABC suspension. They cannot be called relable under any circumstances.

I work on my own cars and have intimate knowledge of them. I spent maybe $3000 on new parts for my S55 over the last 6 months and that does not include labor. I always sell cars in 'as is' condition as all it takes is one minor leak somewhere that can go ignored by the new owner to cause major damage and leave me on the hook for a new engine, gearbox or ABC suspension. Buyer can certainly request a pre purchase inspection from a dealer or mechanic of his choice or purchase and extended warranty.

This sounds like it's one of those laws written by lobbyists for new car dealers who are trying to force smaller traders out of business. It's not really good for anyone.

Really , the consumer should have the freedom of choice. The older the car gets, the more expensive the warranty will be because the risk is greater which again will price a lot of buyers out and turn a lot of perfectly reasonable cars into scrap because sellers will not be able to absorb the price into the cost of the car. That will ruin my favorite hobby of buying really cheap cars that were once very expensive.

Why not better licensing requirements to keep the scoundrels out of the business and a clear disclaimer on whether a car comes with or without a warranty? This is what's done in Texas and works pretty well

.
 
The car should be fit for purpose.

More people need to get TS involved and take the scum to court! They should be fined as well as just paying the costs.
 
Wouldn't it be more rewarding to work with the trade?
