Would not a HPI check have been useful before parting with money, and they provide a guarantee if their info is wrong.

Not for mileage as its basically a load of rubbish... all 3rd party info... e.g. if you write the mileage illegibly at the post office when buying tax, it will be registered with whatever the DVLA think you wrote and that can lead to ALL sorts of problems as ive had experience!
 
How was the car advertised on the autotrader site originally? Did it say specifically it was being sold on behalf of a customer ? If not they havn't a leg to stand on.
 
It was advertised under the traders banner, not on behalf of a customer. I should have printed the advert out - I wonder if Autotrader can access archives for dispute. I know exactly when it was advertised.

or you could always find out where he lives shoot him in one knee cap, threaten to kill all his family unless he gives all your money back, and when he does kill him anyway slowly, very slowly. :devil:

Consumer Direct reckon it's too complicated for them so they've passed it on to the actual Trading Standards Office in my city - well, I mean the city in which I live... I don't actually own a city!

I should have heard from them 3 days ago; as yet, no word so maybe they're scared?
 
Did the MB Dealer supply you with printed proof that the mileage was wrong...
What name was on the log book???... can you contact them to see if the dealer is telling the truth....

And a sale to the public is covered by 3 months warranty minimum.

Hope you don't mind my butting in but was interested in the comments about there not being such as thing as Sold As Seen to the public from a trader.

My daughter has been looking at a Kia Sedona (sorry it's not a Merc) from a local garage but they have told her it is Sold As Seen with no warranty of any sort although it's been MOT'd and would be checked for safety.

Wonder if you explain in more detail so I can tell her.

Basically, my understanding of the law is that a dealer can only sell 'sold as seen' to another trader which is then classed as a 'trade sale'............A dealer/trader is not legally allowed to do a 'trade sale' to a member of the public when a limited warranty must also be included in the sale and, of course, your full consumer rights package.


Edit.........The exception to this is if joe public buys at auction and the auction vehicle is tagged 'sold as seen'.

Agreed, there is no such thing as sold as seen from a dealer to the final consumer with the proviso that it is actually a commercial transaction going through the dealer named on the invoice.
If it were me,after careful consideration,I think I'd storm into the dealer armed with a baseball bat and start clubbing every suit in sight

Consumer Direct told me that it was illegal to sell to public 'sold as seen'. They have to offer minimum of 3 months warranty. I'll 'name and shame' after Trading Standards do their bit - if they ever contact me. I'm sure there is a 'Customer Charter' that they should contact a customer within a certain time frame etc etc?

I did get a printed proof of mileage from MB - all submitted to Trading Standards for their 'action' - eventually!

Stop looking at that Kia, and don't go back to that garage. What the trader is suggesting is illegal, and there are undoubtedly big problems under the bonnet of that car.

Shop them to trading standards for good measure.

I know the garage owner having had dealing with him before, the garage is in the village I live in, and he isn't a dishonest trader.

I hadn't though about his statement until I came across this thread. Just looked at his web site and it states for the vehicle:

If as suggested selling a vehicle under these terms is illegal I'm surprised he is advertsing it in those terms. I'm fairly sure, if he were approached, that he would have some plausible explanation as to why he can sell it as "sold as seen". Although he is as I say a fairly honest trader he still has to be treated with some caution, as do most motor traders.

I think my daughter has decided to look elsewhere anyway so don't need, in this instance, to pursue it further but it is a very interesting point of law which i suspect most punters would be blissfully unaware of.
 
Amazing....Trading Standards have just contacted me with the conclusion to approx 9 months of investigation.

They said...."that they think a previous owner must have changed the odometer"
and have decided to issue the car sales 'showroom' a warning. However, that doesn't stop me taking them to the County Court for civil action under the Sale of Goods Act 1979.

Am I being short-sighted or ungrateful? 9 months to tell me I should take them to court myself. I won't swear here, but what a toothless beast Trading Standards are. I could have taken the car company to the court 9 months ago without being told that by Trading Standards.

What happened to the:
" we'll demand they put things right or you can have a full refund" promises they made me.

A load of ...PANTS
 
I hope you STILL go through with taking the garage to Court.
Maybe he will still give you the compensation you deserve once the case gets near.
NO Trader likes BAD publicity in the local paper.

Well all the info is third party isnt it, no difference imo to a insurance company providing it and an auction house

A few years ago i was looking for a Mercedes Sprinter van , i hunted high and low , my budget was £8k , eventually i found one at a local dealer , it had 80,000miles and was in good nick but looked like it had recieved a blow over .

i asked the dealer about this and he siad it looked scruffy after the signwriting had been removed so they had it done , there was no sign of any accident damage .

There was some supporting documentation but not a lot as the dealer said it had been bought at auction


I did an HPI check and they informed me when the van was at auction it had 160,000 miles on it and had lost these in the few weeks between then and now.

I informed trading standards and gave a statement and they investigated the dealer , about 18months later he stood trial for 45 cases of clocking and deception (even though trading standards had dozens more ) and was found guilty , he got 18 months inside

He was a convicted car theif and was well known for clocking cars and vans having been caught in the past.


Best £40 i ever spent i reckon
