in any case you are talking at least 2.5K difference. I would
a) get trading standards invloved.
b) contact dealer by phone and by registered letter.

if the dealer has any sense then he will take the car back as there is no way he would have made 3K on it to hand back to you..

in any case i dont recommend you keep the car as if mileage has been altered who knows what else they might have bodged..
 
the price is about right for an 86K car with some sort of warranty from a a dealer, with 140K its worth 4k ish...

An E320CDI estate would be at least 8K and a decent one, 9-10K... you would only get a high mileage one for 7K..
 
Reckon you're right. Consumer Direct have been great. Their advice is pretty much as the threads on this topic:
1. write a recorded delivery letter spelling out that the repairs need to be carried out at their expense, with a reasonable contribution from me for usage.
2. request a financial refund of car value between the 88K and 168K
3. make reference to 'time of the essence' in order they get a move on!

Having looked at the Sale Of Goods Act, it says that if an advert describes a feature, it MUST work. This car said it had 'Parktronic', although it never worked.

TOP TIP - if any of you buy a car from a non-merc dealer, test drive it straight to a Merc dealer and ask for a free print-out of the warranty work (because it shows the mileage too) and the features. I did this too late, found the mileage is dodgy and Parktronic was not a feature on the car.

Odd that it has the sensors on the rear bumper, though!

Not really. There are that many aftermarket parking sensors available.

Rear-ended and the local breakers had a suitable bumper but with Parktronic sensors??

Just a suggestion given how well everything else was going :rolleyes:
 
Did they say anything about rejecting the car in full? Given the issues so far I would have thought this may be your best route if you can (if you want to of course it's up to you)
 
they didn't mention returning it...? Maybe the garage will suggest it if they aren't prepared to make a financial adjustment for the excess mileage. It wouldn't be a bad car if the price had reflected the faults and mileage! I hate being ripped off...

Might have to dig my old 190E out and dust it off!
 
I'd want my money back as the car I thought I was buying was not the car that was sold to me. If you're after an £8k car then you don't suddenly want a £5k car. ;)
 
I had a similar issue and a friend put me in contact with a friend (i know, friend of a friend scenario) but he was a trader.

He said that if the trader thought there was significant risk of a claim being successful he would take back the car - that way it could be fixed on the cheap (i.e not at a main dealer) and he could re-sell.

Let me be clear - I am not condoning you turn a blind eye to the dealer taking the car back and pulling the wool over somebody else's eyes. In my case there was a viable economic alternative for the dealer to get the car fixed cheaper than it ended up being.

However, if you're writing to the dealer anyway it may be worthwhile stating at the end that you are prepared for him to simply take the car back and provide a full refund as an immediate solution to your claim.

It sounds like you'll be happier with a financial settlement to rectify the problem though. Your call, of course.
 
Would be interested to hear how you get on. I recently bought a C180k and will be off to Merc dealer for that warranty print in the morning!
 
Latest is: Dealer has responded very apologetically, but says they were selling on a commission-basis for a customer, therefore, there is no liability to refund for incorrect mileage (surely this is a cop-out?).

They have offered labour-free repairs to fan and glowplugs, but I pay for parts (because they say it's wear and tear).

Looks like I've dipped out, to a degree! I'm still waiting to see what Consumer Direct says.

Did they tell you this at sale time and what name is on the receipt?
 
The sellers name is blank on receipt, doesn't even have the car trader name on it. I should have checked the receipt properly on purchase - very slack of me.

They had to put my telephone offer to someone else and phoned me back with the answer, so maybe that was the owner. I thought it was the boss they phoning, though.

Surely it makes no difference what 'basis' they were selling the car on? They were the ones that sold it, end of story. :confused:

Don't take any nonsense. DEMAND your money back or you'll go to the Police/Trading Standards. I wouldn't touch a dealer like this with a barge pole.
 
Trading Standards (now Consumer Direct) are on the case. I've sent a copy of the dealer's letter to them with my observations - very interested to see their response...and of course, I'll keep you informed.

Would not a HPI check have been useful before parting with money, and they provide a guarantee if their info is wrong.
