Mileage Penalties !!!!!

Hi,

Just handed back my Saab after 3 years and bought a new Merc. I was advised by the Merc garage that as I had paid so much of the finance I could just hand the car back as long as there was no excess damage. The Saab was in A1 condition so I thought I would do what was being suggested. I spoke to Saab Finance company and all went well the lady mentioned that I could be billed for any excessive damage but not fair wear and tear, I was happy that car was in excellent condition.
She then made reference to the mileage allowance and that I had to be within the allowed mileage that was stated on the contract, having the contract infront of me I noted on the first page that it said there was an agreed allowance of 47 k miles and as my car had just covered 42k miles I thought all was well and I sent of a letter confirming I was handing back the car.

Over the next 4 weeks I heard nothing from finance company then I received a message on my phone to contact a debt collection agency immediately, I did this and was told that they had been tasked with collecting from me the sum of £1500 , I was shocked and felt it must be a mistake, the debt company were not helpful at all bordering on rude and I was told it was for excess mileage, even at this point I had not received any detailed account for this mileage and I still believed it to be a mistake.

I have now been told that as the car still had a year to run on its contract for which the 47k miles related to, they use a pro rata calculation to work out how much I would be over !!!! I have also now noted that there is a 12k per annum allowance also in the contract.

My main issue is that when i spoke to the lady from Saab Finance about handing car back she never mentioned the pro rata mileage allowance and that it may be used in the way that it is.

The position now is that the debt agency have been cancelled and the finance company say they are waiting till car sells at auction and they will get back to me..................

Any thoughts or suggestions, I am pretty sure that I will owe this amount but I was not given the chance to either pay this sum or keep the Saab as they never once notified me of this amount until my Saab had been collected, denying me of the chance to keep the car...........

i suspect that if it was in the contract, you'll likely have to pay - car finance company's aren't the friendliest beasts so you'd be relying on their potential good will.. good luck!
 
woah , 25p per mile excess! thats steep.

hope you get it sorted , but id guess you will just have to pay them as its normal for mileages etc to reclaimed. Sounds like you were on a PCP with a baloon at the end. If you were on HP im sure there isnt a mention of mileage in those contracts so you wouldnt have this issue.
 
As is always the case it is necessary to understand any Contract before signing; and get concessions in writing. I think you are fortunate that the finance company are considering giving you an concessionary allowance in the event of the car selling well at auction.

You can hardly be surprised that the ''capped'' mileage for a three years term is pro rata in the event of earlier termination. These types of Contract are to some extent a gamble by each Party.....some you win some you lose. I suspect premature termination is rarely likely to be a cost effective option.

To be honest any agreed mileage contract I've ever entered into was on a per annum basis and I've never seen one that stipulated a total mileage. That doesn't mean they don't exist of course but based on my experience you're going to be landed with the bill for the excess. Having said that, it sounds as though Saab are acting fairly and is if they're suggesting they'll decide what you owe once the car's sold. Hopefully if they get a good price for it they may write off the excess but I wouldn't count on it.

Thanks guys for the replies, as I have said I accept its going to be difficult for me to win this one and yes the small print is always worth reading but I made the mistake of trusting the salesman, I had been with the Saab garage for many years and felt they were looking after me, the annoying thing is we stated that we would be changing the car after 3 years and he set up the finance with this in mind.

My main issue is the way the finance company have acted in this, surely when a customer contacts them to enquire how much it would be to end a contract they should check the wording of the contract and give the customer the true cost of ending early. The mileage excess payment was not mentioned to me until they had collected the car so I was not given the option of staying in the contract for the final year and if I had stayed in the contract and kept within the final mileage figure I would not have been liable to pay them anything.


Will just have to wait and see what they say next,

Is it usual for a finance company to pass on the collection of money owed to a debt collection agency straight away, without even approaching you?
