2006 CLS 320 CDI
I bought this car on Sunday, I reckon they have done the dirty on me and pulled the MIL light out, I didn't realise this until later on when I realised that limp mode on this meant it wouldn't go over 3000rpm, so I went out and checked to see if the MIL light would show up and nothing, I got it plugged in and it's got multiple faults, how much is this going to cost me roughly (I know its hard to say) or has anybody got any ideas on where I should look, the seller is denying everything, but the MIL light was on the week previous when I looked at it, it failed its MOT a day later, then passed on the Teusday, I feel I've been completely ripped off, do I fight my corner and go down the misinterpretation act, or do I get it repaired cause I love the car and I'm absolutely gutted.

Do you have a copy of the adver?

If it claims something like "excellent condition" or "no faults" etc then it was misrepresented and gives you a claim.
The advert has gone now from the autotrader, but there was nothing ever stated to say it was under fault condition or that it needs a mechanics attention, I've also threatened that the garage he used has passed the car with a fraudulent MOT certificate, he's trying to offer me £300 to help cover diagnostics and repair but for all I know this could only cover a fraction of the overall cost I initially asked for my money back, but the annoying thing is its his word against mine. 🙆‍♂️

The mil only comes on after maybe 6 consecutive faults . They most likely cleared the faults for the mot and now what Ur seeing is the list of faults repeated.

I'm pretty sure a mil being on at the mot is just an advisory and not a fail.

On the evidence, I'd say he's a crook who knew what was wrong with the car, had the EML sorted so it would pass an MoT, and knows the cost of fixing it will be a good deal more than £300. As Unclebuck suggested, get the fault codes cleared and see what comes back. You may be lucky, but if you don't have a copy of the advertisement, as you say it's his word against yours, and legal action would take at least a couple of years to come to court, and would almost certainly fail anyway.

However... If he's a crook, he may be a dealer masquerading as a private seller, in which case you may have some hope of redress, though the legal action will still be slow. Google his mobile number and see if he has any other cars for sale anywhere, and if you find any, copy the ads and come back to us.

A private buyer doesn't have to declare faults.

That wasn't my point though . If the advert had said that car was in good condition mechanically then it could have given you cause to claim misrepresentation.

How can you be sure that the MOT was fraudulent?

What evidence do you have for that? I would be cautious about such accusations without evidence. Have you thought of getting a garage you trust to go through an MOT and see what that shows?

Did not know that 👍👍

An engine MIL inoperative or indicating a malfunction is a Major; Mot Tester's Manual 8.2.2.2 g refers.

Well that's it init, I'd need to build evidence up before I can complain to the dvsa, I do have a trusted garage I always use, after speaking to them and them having a look around they suspect foul play, but I haven't let anybody touch the car properly yet as I'm unsure what to do.

Can you actually find if "said person" has car sales this way by just using the mobile number

An illuminated Check Engine Light that stays on when the engine is running is an MOT fail.

If the CEL doesn't illuminate when the ignition is turned on is also a fail

Yeah the CEL doesn't come on when the ignition is turned on, I'm annoyed at myself cause I never checked it there before exchanged keys and cash, I just looked saw it wasn't on anymore 🤦 as I was driving home I was having a play and noticed it would max out at 3000rpm, (new to the mercedes world) put it down to not having a decent run for a while and thought overtime may run a little better, but as I started to look into stuff realised that it was limp mode (limp mode for me in the past is 30mph) and then discovered the CEL in-op so I messaged the seller next morning.

That was the report from last Monday, then on the Tuesday it "passed" and now the CEL is in-op, surely can't be a coincidence.

They've obviously reset the cel for the mot , and now it's back on.

Thanks for confirming. 👍
