With injury claims the insurance company will normally assign an injury lawyer for you, which they seem to have done . The insurance companies have now set basic payouts for certain injuries.

When I was rear ended a couple of years ago after a few forms and a brief once over by a doctor from the insurance firm I was paid £1500 for the whiplash, I actually had pains in the tops of my legs which was a result of the whiplash, she should look out for that and pains in the arms, numbness in the fingers too could be caused by nerve inflamation caused by the whiplash. took about 3 months in total to receive the settlement. I was told if I wanted more I would have to pay the fees myself.

She should go to the doctors for any ill affects she may be suffering from that could be linked to the crash, as the payouts are based on time to recover and and what she is not able to do. ie lofting any kids, normal daily routine that is affected.


Just a bit concerned that the other driver admitted liability at the scene. I was always told not to do this as the insurance companies get upset.
 
Sorry to hear about this, and i'm glad your 2 babies weren't hurt in the process that could've been a real tragedy.

Depends how well you get on with your X, maybe the kids your at this moment in time? but at least you know they are ok, so you could complete your US trip and come back to them safely...
 
glad to hear she's ok in the circumstances - I know I would still be worried about my ex, not to mention thinking my children may need my support at this time, shame she doesn't see it the sme way (?!). I know she's 'refused' your offer of helping with the children but if you think they need your support that's where your priority should lie

in answer to you questions:

1 - dunno (sorry)
2 - she can, but is under a duty to mitigate her claim - be careful of recent case law which is trying to curb excessive (and I don't know the circumstances so not saying her claim is excessive) like for like replacement
3 - in these circumstances and the severity of the incident, with a doctor and a lawyer, I am not a claim monkey but there's no indecision in my mind if she's rolled

I was recently rear-ended in a low speed knock. In my experience the insurers are now all set up for clearing these cases asap but are wary of people trying it on. In my case I waived any PI claim and agreed they could give me any replacement car so long as it had 4 doors and could fit a set of golf clubs, which we all agreed was reasonable. As a result it was all done and dusted in one morning.
