I saw someone in the daily mail the other day in trouble for drinking a slushie at the lights and looked up whether having the handbrake on would have prevented it being an offence.

Don't know why but I always thought having the handbrake on at lights allowed you to get away with due care and attention things. If that's the case, my question would be whether sbc hold is counted as a handbrake?

Rumour has it that the offence wasn't quite reported properly in the Mail and may well have involved the vehicle moving.

Nope.

Try using your phone at the lights without your hadbrake on in full view of the gentlemen in blue.

You should be parked up and not just paused while making progress.

My understanding is that when drinking a slushie the rather fuzzy test to be applied is whether you are in control of the vehicle. Not whether you are drinking a slushie. Trouble is that 'fuzzy' aspect when it comes to judging the situation and say issuing a FPN.
