Playing devils advocate though, if you or I buy a car off E-bay without checking out the documentation, then we are asking for problems.

I steal your car, sell it on E-bay and simply tell the new owner the documentation has all been sent off to the DVLA. Seven days later you see the new owner with your pride and joy, you tell the Police, should the Police say tough? Should the new owner keep the car because he paid a fair price and had no reason to suspect the car was stolen? Should the insurance company still pay out because we could argue the car has been located!

If we then say your car was not seen until after the insurance paid you, then surely the insurance company has that same right to claim their property?

If however the new owner before buying the vehicle off e-bay checked out the documentation and when he paid for this vehicle they were given excellent forged documentation, or your V5 which you kept in the glove-box, has the situation changed?

Always perform your own HPI check a this gives financial protection in case of a fraidulant sale.
If a dealer or other seller does the check for you, you don't have this protection.

Be warned.

Both.
They are paying in leu of the vehicle and if it is subsequently found it is then their property.
If it is found before a payout you get the car back or not depending on cost to repair.
