W213 Turbo Whistling Noise

Hi All ,
Need some help sorting this one out .
In a nutshell , the turbo is making a whistling noise when accelerating. Have been to a Mercedes Garage and they diagnosed it and obviously priced it incredibly high to replace .
The warranty company would not support the claim because of "wear and tear " . Apparently the Mercedes Engineer said to them on the phone that the whistling noise is coming from a worn out bearing inside the turbo . As soon as the company heard that, deemed it wear and tear and will not pay for it.
I bought this car about 7 months ago with a full comprehensive warranty ( paid extra for it ) , have put 8k miles on it .
The car now has 75k miles , which I think it`s still to early for a turbo failure.
Any questions just ask, thanks.
Anyone has any ideas on how to sort this out , please?
What options do I have?

Hmm.....pity it was not within 6 months then the law would be on your side....its still can help after six months but the element of proof falls on you to prove the fault was there when you bought it or its of unsatisfactory quality.....even then it still may be considered wear and tear. Up until 6 months the law assumes the fault WAS there at purchase.

Have a looks at Consumer rights 2015. This is from it...

It’s worth bearing in mind that, if the issue occurs in the first six months after buying the car, it’s up to the selling dealership or garage to prove that it was of satisfactory quality, fit for purpose and as described when they sold it to you. However, if you want to reject your car for a full refund within the first 30 days, or the problem happens six months or more after you bought the vehicle, you – the consumer, needs to be able to prove that the car was not of satisfactory quality, unfit for purpose or not as described when you bought it. This will normally be through either a diagnosis from a garage or dealership, or an independent technical report.
