Artics in lane three

Are they ever allowed? This was southbound a couple of weekends ago near the Silverstone exit on the M1. Traffic was stationary - but does that make it ok?

I believe so, I guess it depends on interpretation of whether the motorway is 2 or 3 lane then - and if it still counts as 3-lane then it would depend on which lane is closed?
 
well i thought people frowned at those ignoring one law and accepting others.
Afterall people using mobile phones never did anyone any harm, until just before they crashed

Was OP using a mobile to take pictures of the lorry while driving?
 
well if you could be done for drink driving even when your car is off, and you are asleep in the back seat, then driving is being anywhere in the car.
Or does that just apply when it is drink driving charge related?

That's drunk in charge of a motor vehicle. For which you can be disqualified from driving.
