As i am right cheap. I bought my detached dwelling at a ridiculously low price (Not much more than i paid for the SLK55). it is 6meters from one of them overhead lines. and the lines do go over the garden. this has a percived health risk. totally unfounded but none the less percieved and this reduces the price. which is why i got it cheap.! i didnt believe the price, and genuinely thought it was a printing error.

still, last year the firm that i have put the link to, stuffed some things thru my letterbox. as i was spending lots of time in, (thansk mainly to having glass bones which i smashed) i rang them and they came and surveyed the house. they said i had a case. they take 20% of the claim if the win. as i didnt know of this, and probaly wouldn't have pursued if i had, i gave it ago.

Tuesday they told me they have submiited the claim with the leccy distributors. along with a few hundred others as it happens.

needless to say, once the legal shenangins are over I shall be a few thousand pounds happier!. in fact it may be better to say ten thousand pounds happier...

all for the sake of answering a phone call three times, letting someone value my house and waiting I am now £4500 better off so they told me today.

for interest, they originally claimed for £12000, but you know how it is, that meant i would have got £9600. they settled for somewhere around £5700. And as i said, I didnt do anything for it.

What did they actually do for you?

Mount a claim for diminution in the value of property due to electrical apparatus or convert a Wayleave into a Deed of Easement in return for a capital sum.

There is a house for sale near where i work, nice little Kent village, directly under power lines. I might buy it and see how much I get back!

Seriously though, will you win the claim if you bought the house at a reduced price because the power lines were already there?

Wouldn't you know. I have a pylon in my back garden (see pic) but I've just discovered that a previous owner of my property has already entered into a permanent easement meaning that a Deed of Grant would be in place preventing any future right to compensation because the Deed is not subject to a Development Clause.

Typical!!

I think the wayleave converted is the what has occured. They survey the house as you would when selling, and then assume an amount that being near the lines, and their perceived health risk, reduces the price by.

the advantage for yorkshire electricity is, that when i bought the house, the mortage survey reduced the price of the house from its asking price by, exactly £4500. That was in 2001. It didnt make a differnece to me as I wasnt borrowing any where near the house value, but it could have done for someone else. It was surveyed last year by this company and also by yorkshire leccy's agent surveyor. 35 claims went in with mine. YEB was offering about a 3rd and they settled at around half.

I know that once i have it, nobody else can claim on this plot.

It all came about when a guy near me wanted to sell his houe and had trouble. the pylon is out the back of his house. He found out about this firm and they put flyers through the door. I rang them. They told me what they did, and sent me some further info and a from to sign if i wanted them to do anything. then they called round to look, drew up a claim and sent me a copy.

rang me when things occured, and this week told me what was happening.

I literally have done nothing for this, and wouldnt have bothered if they hadnt been round. I cant see the lines frr the house, you have to go into the garden, and they are not anything that bothers me. so i look at it as £4500 for being lucky.

I suppose i could have taken them on myself or demaded more, but some of that would cost. so i dont mind really.

I am sure it will be finding its way onto a deposit for another car!

I intend to go out £4m in the red. i cant wait till they dig me up demanding repayment!

Permenant easement is what it ended up being. Solicitor adding to the title deeds as we speak so that nobody else has a claim at this address.

it has been known that pylons close to an expensive car can cause intermittent leaks of an oil / water type liquid and make the owner think their stealers are being irrational..... :D

i never thought of that. i must dash round and appologise to the incompetant "retailer!!!"

I do think i may well not be welcome in the place though. and Mercedes have my feedback on its way to them.

and whilst out driving to lower my irritation with their total buffoonery, i happended accross a new MB service only building being readied for opening in the next few weeks at Skipdale (Skipton for those who dont watch Enemadale). I remember that useless dealer telling me MB were going to build one near here, a few years ago. they had nothing to do with it. (edit: been for a ride round this morning as it was sunny, and its going to be a retailer and not service only, opens soons, and its a smaller retailer so it could be a decent one. If HL Gorner runs it like the did the Clapham one)

I will not be suprised if they close down the service department at my local MB dealer. just let them sell cars and have someone else deal with the problems. it does make sense as the local dealer is obviously wasting Merc money. they had the sealant to do my car the day it came in. they kept it 3 days. for why?

I actually think after my phone call to them to question the gearbox oil seal, they decided to bluff there way out of it. as i suspect they would have done nothing but told Mercedes it needed extra. I must have come over a bit itimidating on the phone. They certainly cowered when i raised my voice in the dealer. its amusing looking up at a guy who almost appears to be trembling. His conflict management skills were useless! good job my arent!!

I know this is simple, but the easiest way to satisfy people is to do the job right, properly and keep them updated. its not difficult is it.

where is it? i've just booked mine into North Riding Motors at Pickering on the same "small is beautiful" premise...
 
that road out of skipton towards keighley.. just before the hotel opposite midegly cars and Bentleys head office.

not sure if its open yet but it will be very soon.
